North Carolina Administrative Code (NCAC) 13B .0844 (b) states: All permitted septage management firms shall display decals or lettering on each side of every pumper vehicle operated by the firm. The decals or lettering shall include the name, address (town name), phone number, and septage management firm permit number. All decals or lettering on the pumper vehicle shall be no less than three inches in height and plainly visible. Identification shall be permanently attached (i.e., no removable signs). Cooke Rentals was in violation of NCAC 13B .0844 (b) because the address (town name) and the phone number was measured to be less than three inches in height on both sides of the pumper vehicle. In order to come into compliance, Cooke Rentals must correct the lettering for the address (town name) and phone number on both sides of the pumper vehicle to measure at least 3 inches in height. After completion, submit a photograph of the completed lettering along with a ruler (see photograph below) confirming the corrections, to troy.harrison@ncdenr.gov by March 13, 2017. North Carolina General Statute (NCGS) 130A-291.1 (h1) states in part: “A permitted septage management firm shall notify the Department within 10 days of placing a pumper truck in service that was not previously included in a permit issued to the firm and shall make the pumper truck available for inspection by the Department.” Cooke Rentals was in violation of NCGS 130A-291.1 (h1) because the pumper vehicle was placed in service in July 2016, 2016 and the North Carolina Solid Waste Section-Asheville Regional Office inspector was notified on February 7, 2016 by North Carolina Solid Waste Section-Central Office staff. No further action is necessary. ADDITIONAL COMMENTS 1. The inspection was conducted at Cooke Rentals in Mt. Airy, Surry County, North Carolina. 2. The following firm truck was inspected: Vehicle Identification Number (VIN) NC Tag Number IFDUF5GT5FEC84441 FF-5165 Photos taken by Troy Harrison on 2/21/2017 3. The tank appeared to be structurally sound and bolted to the frame. 4. Valves and access ports appeared to be secure. Caps were present on the access ports. 5. The truck was properly marked in accordance with the lettering requirements with the exception of the address (city name) and phone number which was under 3 inches in height. 6. No leaks were observed. 7. According to Cooke Rentals, the pumper vehicle was placed in operation approximately in June 2016. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
