Permit to Operate – Life of Site (Phase 1 – Cell 1, 2 & 3 and Phase 2 – Cell 4 and Cell 5) is currently in DRAFT form. PURPOSE OF SITE VISIT: Pre-Operations Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The pre-operations inspection was performed to confirm the completion of Phase 2 – Cell 5 and its status and condition. 2. The draft Permit to Operate and the revised Operations Plan were reviewed prior to conducting the field inspection of the new cell. 3. Discussions focused on changes in the permit language, and Mr. Chao explained that these changes had been adopted as a part of the format for all life of site permits. 4. The new Permit to Operate will be issued as a life of site permit. 5. The field inspection was made from the top of the slope of the new cell looking over it toward the currently active Cell 4. A large portion of this slope was covered with “wind defender,” a synthetic fabric used to channel the wind and avoid damage to the slope and liner that might otherwise result. 7. A gravel access road and tipping area had been created for use in filling the first lift. 8. Side slopes were properly graded with vegetative cover already well established. 9. A repair area was visible on the far slope, as well as a few small rills. Mr. Dingman confirmed that side slopes will be maintained regularly in order to prevent erosion from occurring. 10. Mr. Chao stated that the CQA document and the field inspection confirmed that the new cell is ready for use. Mr. Gibson estimated that Cell 5 would likely begin receiving waste in July or August 2017.
