STATUS OF PERMIT:
A Land Clearing and Inert Debris Notification was received by the Solid Waste Section on June 9, 2016. The
Notification was filed for recordation with the Ashe County Register of Deeds on June 8, 2016.

OBSERVED VIOLATIONS:
15A North Carolina Administrative Code 13B .0566(2) states: “The facility shall only accept those solid wastes which
it is permitted to receive.”
During the inspection, multiple shingles, pieces of metal, a metal window screen, a piece of painted wood, a metal food
can, and sheet plastic or silt fence were observed within the working face. The aforementioned wastes are unacceptable
for disposal in a Land Clearing and Inert Debris Landfill. Therefore, Anthony Brinegar is in violation of 15A NCAC 13B
.0566(2).

To achieve compliance, within 30-days of receipt of this inspection report, all unacceptable wastes must be removed and
properly disposed at a solid waste management facility permitted by the Division of Waste Management. Proof of
disposal must be provided by submitting all solid waste management facility receipts where waste is disposed to the Solid
Waste Section. Receipts for disposal should be mailed to:

ADDITIONAL COMMENTS
1. The facility is located on a 48.96-acre parcel of land located on Hudler Town Road and is owned by Keith A. &
Tammy L. Huffman.
2. A gate was located at the entrance to the facility to prevent unauthorized access. The gate was closed and locked
upon arrival at the site.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

3. 15A North Carolina Administrative Code 13B .0566(16) requires a sign be posted at the facility entrance showing
the contact number name and number in case of an emergency. No sign was posted at the time of inspection.
Please ensure that a sign is posted to ensure compliance with 15A NCAC 13B .0566(16).
4. A diversion ditch had been constructed above the working face to divert surface water from the waste area.
5. Seven tires, a metal spring, and a small piece of painted wood were observed adjacent to the gate at the entrance to
the facility. It appeared that these items had been staged for removal and proper disposal.
6. The landfill appeared to be in the early stages of construction and appeared to be less than two acres in size.
7. It appeared that the working face of the landfill was located within the required buffer limits. However, It
appeared that some logs that were placed on site for disposal may have been located within the required 100-foot
buffer to the northern property boundary. Please ensure that any material staged for disposal is not placed within
the required buffers set forth in 15A North Carolina Administrative Code 13B .0564(9)(b).
8. No off-site sedimentation or erosion was observed.
9. A skimmer sediment basin had been provided southeast of the landfill area. It did not appear that installation of
the laminated plastic within the emergency spillway was complete. Please ensure that construction of the device is
completed as soon as possible to ensure proper function.
10. The working face was less than one acre in size.
11. Edge of waste markers must be provided to clearly delineate the limits of the landfill area and to ensure that the
facility remains within the required footprint of less than 2-acres and buffers are maintained.
