Dear Mr. Gurley,
The NC Solid Waste Section has completed a review of the Groundwater and Surface Water Monitoring
Results-Second Semi-Annual 2016 Event dated January 24, 2017 (DIN 27442) submitted on your behalf by
Jett Environmental Consulting for the Lake Norman C&D Landfill, NC Solid Waste Permit Number 5504.
The landfill has been in the Assessment Monitoring Program since 2015 pursuant to 15A NCAC 13B .0545,
in response to consistent groundwater exceedances of the Appendix I volatile organic compound,
methylene chloride, at the landfill.
Methylene chloride detections or exceedances have not been documented at the landfill for at least two
consecutive groundwater monitoring events. Since methylene chloride has not been detected, within the
Groundwater and Surface Water Monitoring Results-Second Semi-Annual 2016 Event report, Republic
Services is requesting for the landfill to revert back to the Detection Monitoring Program.
As a result, the request to revert back to the Detection Monitoring Program is contingent upon addressing
the Appendix I inorganic constituents that have been consistently exceeding the NC 2L Groundwater
Standards (15A NCAC 02L .0202) within the groundwater monitoring wells. Based upon these inorganic
exceedances, additional action is required. Please perform one of the two following actions in accordance
with the rules:
In accordance with 15A NCAC 13B .0545(b)(8), the owner or operator may demonstrate that a
source other than a C&DLF caused the contamination. An alternate source demonstration (ASD)
report must be prepared by a certified Licensed Geologist and submitted for approval by the
Division. A copy of the approved report must also be placed in the operating record. If a successful
demonstration is made, the owner or operator may discontinue assessment monitoring, and may
return to detection monitoring if the constituents are at or below background values and 15A
NCAC 02L .0202 or approval is given by the Division according to Subparagraph (9) of this
Paragraph; or
In accordance with 15A NCAC 13B .0545, continue in the Assessment Monitoring Program.
If an alternate source demonstration is submitted and the NC Solid Waste Section approves the
demonstration, the landfill can revert back to the Detection Monitoring Program. If the NC Solid Waste
Section does not approve the alternate source demonstration, the landfill should continue in the
Assessment Monitoring Program in accordance with 15A NCAC 13B .0545.
