PURPOSE OF SITE VISIT:
Comprehensive Inspection
STATUS OF PAST NOTED VIOLATIONS:
1. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0566(4) states: “Adequate soil cover shall be
applied monthly, or when the active area reaches one acre in size, whichever occurs first.” At the time of this
inspection, the fire had been extinguished. No smoke was emanating from the material within the fire break, and it
was possible to walk throughout the entire fire area. Mr. Howerton stated that the material in the fire area had
been sprayed with water for a number of days in order to cool the material and prevent further outbreaks of fire in
the pile. He explained that, as it had been safe to do so, his equipment operator had begun pulling apart the pile
and digging down into it to ensure that no smoldering was still taking place in the interior of the pile. He also
pointed out an area where excavation work was beginning: mulch was being pulled back to expose the ground
around the unprocessed wood debris pile on the southeast side of the fire area. This will be the initial fill area. Mr.
Howerton reaffirmed that he is working toward completion by the March 15, 2017 compliance deadline.

ADDITIONAL COMMENTS
1. No waste has been accepted at the site since before the fire event began on January 16, 2017.
2. Mr. Brown provided a copy of the Davidson County Special Use Permit, dated December 18, 2014, for the file.
3. Mr. Howerton guided us through the site and into the fire area. No heat or smoke was observed anywhere on the
site during this inspection.
4. Based on approximate measurements using aerial photography, the estimated size of the LCID operations at this
time is 1.70 acres. This is a larger area than the 1.3-acre area designated by Davidson County in the special use
permit that was issued for the site. Mr. Brown stated that as long as the LCID did not exceed 10 acres in size,
Davidson County’s approval covers the operations. Should the fill area increase to a size of more than 2
acres, a full LCID landfill permit must be obtained, as required by 15A NCAC 13B .0563(3)(b).
5. It is recommended that permanent edge of waste markers be installed at the facility to ensure that waste
does not exceed the designated waste boundaries.
6. The trench that had served as the initial fire break around the fire area had been widened and was being used as
a roadway for the heavy equipment navigating the site.
7. Mr. Howerton stated that he will continue with the plan discussed on January 31, 2017, to excavate small cells
and fill them, allowing him to clear areas, gain cover soil and have room to move the wood debris stockpiles as
needed.
8. At the time of this inspection, the drainage ditches had been cleared and the sediment basins had been cleaned
out. No erosion or sedimentation was observed on the site.
9. Silt fencing was observed to be in place and functional in the area west of the soil stockpiles.
10. The pile of large stumps and logs at the northwest limit of the fire area, where ignition was presumed to have
occurred, had been pulled apart and the mulch that had been mixed with the pile had been removed.
11. No unacceptable waste was observed at the facility.
12. The remainder of the parking area and a large expanse to the southwest of the parking area had been cleared of
wood debris and leveled.
13. The Solid Waste Section will perform additional inspections to ensure that the facility does not exceed 2
acres in size and complies with all of the rules and operational requirements contained in 15A NCAC 13B
.0563 through .0566.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
