REGAN Secretary MICHAEL SCOTT Director February 16, 2017 CERTIFIED MAIL 7015 1520 0003 5462 8827 RETURN RECEIPT REQUESTED Steve Sinaly, Regional Vice-President 1640 Talleyrand Ave. Jacksonville, Florida 32206 SUBJECT: Notice of Violation Compliance Inspection Report Liquid Environmental Solutions of Georgia, LLC SDTF-34-06 Forsyth Dear Mr. Sinaly: On February 15, 2017, Stephen Berry and Daniel Seagraves, Senior Environmental Specialists, Forsyth County Office of Environmental Assistance, inspected the above referenced facility for compliance with North Carolina solid waste statutes and rules. The following violations were noted: A. 15A North Carolina Administrative Code (NCAC) 13B .0841(g) states: “The permit holder of a septage treatment or detention facility shall control odors from the facility at the property boundary”. North Carolina Solid Waste Permit SDTF-34-06, Operating Permit Condition #3 states in part: “The method for controlling odors described in the approved application for this permit must effectively control all odors created by the operation of this facility as required by 15A NCAC 13B .0841(g)”. Liquid Environmental Solutions of Georgia, LLC, was in violation of A NCAC 13B .0841(g) and North Carolina Solid Waste Permit SDTF-34-05, Operating Condition #3 because offensive odors were observed by Forsyth County Office of Environmental Assistance Staff at approximately 11:05 AM at the intersection of Clemmonsville Road and Palmer Lane and at the intersection of Palmer Land and Rothrock Street on February 15, 2016. Based upon the foregoing, Liquid Environmental Solutions of Georgia, LLC shall come into compliance by with all requirements of the regulations in 15A NCAC 13B 15A NCAC 13B 13B .0841(g) and North Carolina Solid Waste Permit SDTF-34-06, Operating Permit Condition #3 by completing the following: Liquid Environmental Solutions of Georgia, LLC Notice of Violation Page 2 of 2 February 16, 2017 1. A corrective action plan must be submitted to the Division of Waste Management, Solid Waste Section within 30-days of receipt of this Notice of Violation, identifying the source of the odor emissions and a proposed remedy. If approved, the plan must be implemented within 60-days of receipt of this Notice of Violation. The plan must be submitted to: Tony Gallagher, Branch Head Composting & Land Application Branch 1646 Mail Service Center Raleigh, North Carolina 27699-1646 The violations listed above were observed by Forsyth County Office of Environmental Assistance staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct a follow-up inspection(s) to verify that the facility has completed the requirements of this Notice of Violation.
