North Carolina Solid Waste Permit SDTF-34-06, Operating Permit Condition #3 states: “The method for controlling odors described in the approved application for this permit must effectively control all odors created by the operation of this facility as required by 15A NCAC 13B .0841(g). The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. On February 15, 2017, a complaint was received from Jeff Warner, Fire Captain, City of Winston-Salem via telephone concerning Liquid Environmental Solutions of Georgia (LES). He stated that the smell was terrible this morning and has been bad for the last 30 days. 2. I (Troy Harrison), contacted Michael Settle, Forsyth County Office of Environmental Assistance and Protection (Forsyth County) and informed him of the complaint. Stephen Berry and Daniel Seagraves both of Forsyth County conducted an investigation at approximately 11:05 AM. The report states: “2/15/17 – Stephen Berry and Daniel Segraves (investigators) investigated the complaint; investigators arrived at the location at approximately 11:05am. Offensive odor was detected immediately at the intersection of Clemmonsville Road and Palmer Lane. Wind direction was generally from the east-northeast to the west-southwest; odor was most prevalent at the southeast corner of the facility’s property line (intersection of Palmer Lane and Rothrock Street). Investigators drove to the northern limit of Palmer Lane and detected no odor; investigators left Palmer Lane at approximately 11:11am. Investigators also traveled to Rhyne Street (west of facility) and no odor was detected. Investigators left the area at approximately 11:20am. At the time of the investigation, a Valley Protein tanker truck was unloading product. Another Liquid Environmental tanker (without truck cab) was situated adjacent to the silos and next to (northwest of) the unloading dock. No photos were obtained at the time of investigation.” 3. On 2/16/2017 at 11:40 AM, I spoke with Jim Mayberry, Process Facilities Manager, LES concerning the complaint. I asked if there has been any change in the operation, he stated that only the volume has increased. I also asked if the facility was following the “odor control plan” and he said that they were.
