OBSERVED VIOLATIONS:
1. Permit Condition 2 - Field 1 is currently inactive. Permit Condition 7 - No land application may occur on Field 1
until the Division has inspected the site and found it to be in compliance with all permit conditions and the
approved nutrient management plan. Land application has occurred on Field 1 while under an inactive
status as requested by Mr. Oaks under the current permit.
2. 15A NCAC 13B .0838(a)(18) - Approved nutrient management plans shall be followed. The land application
event that occurred on Field 1 was discharged on a crop other than the approved crop (fescue) to receive septage.
Other crops were planted on Field 1, but only because no land application was occurring due to the inactive status
for this particular field. No land application shall occur on Field 1 until an adequate fescue crop is
established & the status is changed to “active”. Please contact this office if you wish to change the status for
Field 1. At this time land application shall only occur on Field 2.

ADDITIONAL COMMENTS
1. There are missing stakes at the swale on Field 2. Land application has occurred on Field 2 and it is under an
active status which means it shall be in compliance for land application to occur. Please repost the required
stakes to clearly delineate the permitted boundaries. Discussed this with Mr. Oaks.
2. The required signs are posted and the access road is adequate.
3. It appears that the approved setbacks are being met. No sign of land application outside the permitted
boundaries. However it was noted that a discharge event came very close to the access path at the front of Field
2. Please ensure that no septage is applied to the access path as there is not adequate fescue on this strip.
4. Noted areas of damage from hogs on field 2. Please continue efforts to repair these areas, control weeds and
maintain the fescue cropstand.
5. No heavy application noted. No odors noted.

such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
