Submit request for permit review no later than 11/28/17. PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: 1. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B. 1626(7)(a) cited for failure to prevent silt from leaving the MSWLF facility. No silt was observed leaving the landfill on this date. Slope repairs were in progress as a result of damage from recent heavy snow and rain events. Some areas will likely require additional seeding in order to achieve the stable vegetative cover needed to prevent future problems with sedimentation. 2. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B. 1626(7)(b) cited for failure to prevent on- site erosion. After several attempts at seeding had failed due to weather-related issues, many areas of the landfill cap were green (see attached photos). Mr. Sink stated that spot seeding would again be undertaken as slope repairs are completed in order to re-establish the vegetative cover that had begun to sprout before the recent dry spell. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B. 1626(7)(c) cited for failure to provide for a vegetative cover sufficient to restrain erosion within 30 working days or 120 calendar days of completion of any phase of MSWLF development. For the first time since the original inspection of June 2, 2016, vegetative cover at the MSW landfill appears to be taking hold in most areas of the landfill cap. Mr. Sink stated that snow and rain related slope repairs are being completed and that he will spot seed the repair areas as needed to provide overall vegetative cover. SUMMARY OF VIOLATIONS AND CORRECTIVE MEASURES: The previously observed violations addressed above relate to erosion and sedimentation control at the MSW landfill. Although corrective measures were undertaken immediately after the initial inspection on June 2, 2016, a series of heavy rain events washed away the cover that had been added to the side slopes, and eliminated the seeding that has been done on three separate occasions. The fourth attempt at re-seeding failed due to extremely dry conditions. Because all possible efforts had been made to comply with all established compliance dates, the deadline had been extended until January 31, 2017. Based on observations, the vegetative cover is now taking hold and, if the weather holds, it should be well established in the near future. Additional slope repairs have been necessary due to damage from recent heavy snow and rain events, and spot seeding will be required. For these reasons, the deadline will be extended to March 31, 2017, when compliance must be demonstrated through established vegetative cover on Area 1 and Area 2/Cell 1 of the active MSW landfill. OBSERVED VIOLATIONS: No additional violations were observed during this inspection. ADDITIONAL COMMENTS 1. Vegetative cover on the MSW landfill was observed to be taking hold. Mr. Sink stated that several areas of erosion had resulted from damage to the slopes caused by the recent heavy snow and rain events. He explained that repairs were underway and that spot seeding would be needed to encourage vegetative cover in those areas. 2. The approved closure plan for the C&D landfill, with its approved alternative final cover, was observed to be well underway during this inspection. Mr. Sink stated that the contractor estimated the completion date to be within approximately 90 days. 3. Some small areas of erosion were visible again on the C&D landfill on the southwestern slope; however, the contractor was maintaining a small berm to prevent runoff until that portion of the cap receives final cover during the closure process. 4. A small number of white goods was observed to be properly stored on the ground in the collection area. Mr. Sink stated that the CFCs had already been removed from these units, and staff would be compacting and preparing them for transport as time permitted. 5. Rock crushing work was still underway at the time of this inspection. Stockpiles of rock and gravel generated by the crushing operation were observed in the area south of the new cell. Mr. Sink stated that the crushing contractor had almost completed his operations. 6. The entire facility was observed to be clean and well-maintained. Mr. Sink stated that inmates continue to be used to collect and remove windblown litter throughout the facility on a daily basis, as required by 15 NCAC 13B .1626(11)(c). The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
