STATUS OF PERMIT:
Expired; Permit to Operate (PTO) issued 21 July 2009, expired 21 July 2014. Pursuant to 15A NCAC 13B .0201(c)
and .0206(a) a complete permit review request including updated Facility, Operations, and Waste Screening Plans was
due on or before 21 March 2014.
PURPOSE OF SITE VISIT:
Partial Facility Compliance Inspection without records review
STATUS OF PAST NOTED VIOLATIONS:
None applicable
OBSERVED VIOLATIONS:
1) 15A NCAC 13B .0542 (a) states “The owner or operator of a C&DLF unit must maintain and operate
the facility in accordance with the operation plan prepared in accordance with this Rule.”

PERMIT NO. 74-07-CDLF-2009 ATTACHMENT 1 PART IV: GENERAL CONDITIONS (6) states
“Construction and operation of this solid waste management facility must be in accordance with the Solid
Waste Management Rules, 15A NCAC 13B, Article 9 of Chapter 130A of the North Carolina General
Statutes (NCGS 130A-290, et seq.), the conditions contained in this permit; and the approved plan.”

(18) states “All required sedimentation and erosion control measures must be installed and operable to
mitigate excessive on-site erosion and to prevent silt from leaving the area of the landfill unit during the
service life of the facility.”

PERMIT NO. 74-07-CDLF-2009 ATTACHMENT 3 PART I: OPERATING CONDITIONS (13) states
“The use of alternative periodic cover requires approval, prior to implementation, by the Section.”
2) 15A NCAC 13B .0542 (f)(1) states “…the owners and operators of all C&DLF units must cover the solid
waste with six inches of earthen material when the waste disposal area exceeds one-half acre and at least once
weekly.”
3) 15A NCAC 13B .0542 (f)(2) states “…areas which will not have additional wastes placed on them for three
months or more, but where final termination of disposal operations has not occurred, must be covered and
stabilized with vegetative ground cover or other stabilizing material.”
4) 15A NCAC 13B .0542 (k)(1) states “Adequate sediment control measures consisting of vegetative cover,
materials, structures or devices must be utilized to prevent sediment from leaving the C&DLF facility.”
5) 15A NCAC 13B .0542 (k)(3) states “Provisions for a vegetative ground cover sufficient to restrain erosion
must be accomplished as directed by appropriate state or local agency upon completion of any phase of
C&DLF development consistent with Rule .0543(c)(5) of this Section.”
6) 15A NCAC 13B .0542 (l)(4) states “Leachate must be contained on-site or treated prior to discharge.”
ADDITIONAL COMMENTS:
1) This Facility is a Construction and Demolition Landfill, White Goods Collection, and Scrap Tire Collection
facility.
2) This Facility is permitted to receive Construction and Demolition (C&D) waste as defined in 15 NCAC 13B
.0532(8); Inert Debris as defined in GS 130A-290 (a)(14); Land-clearing waste as defined in GS 130A-290
(a)(15); Asphalt in accordance with GS 130-294 (m); and regulated-asbestos containing material in
accordance with 40 CFR 61 and 15 NCAC 13B .0542 (c).
3) This Facility is permitted to receive the aforementioned wastes generated within a 100-mile radius of the
Facility. Counties included in the permitted area are Beaufort, Bertie, Bladen, Camden, Carteret, Chatham,
Chowan, Craven, Cumberland, Currituck, Dare, Duplin, Durham, Edgecombe, Franklin, Gates, Granville,
Greene, Halifax, Harnett, Hertford, Hyde, Johnston, Jones, Lenoir, Martin, Nash, New Hanover,
Northampton, Onslow, Pamlico, Pasquotank, Pender, Perquimans, Pitt, Sampson, Tyrrell, Vance, Wake,
Warren, Washington, Wayne, and Wilson Counties.
4) This Facility is currently operating in Phase II.
5) Proper signage including the Facility permit number, accepted waste types, banned or excluded items, hours
of operation, and the emergency contact number is posted at the Facility entrance.
6) The hours of operation are Monday through Friday 7:00 AM to 5:00 PM.
7) The Facility is secured by means of a locked gate at the Facility entrance.
8) The entrance to the Facility is well maintained and no windblown debris was noted along the roadway
approaching the site.
9) The Facility access road is of all-weather construction and is being maintained in overall good condition.
10) Ground vegetative material is being stockpiled in an area adjacent to the northern end of Phase II for use in
weekly cover and erosion repair. This stockpile needs to be maintained at a minimum of 50 feet from all

with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

surface water ditches. *Please ensure all required buffers are established and maintained around all ground
vegetative material stockpiles.
11) The groundwater monitoring wells were observed during this Facility Compliance Inspection. Some of the
reviewed wells were not readily accessible and secured with functional locks. *Please ensure that all
monitoring wells are maintained secured with functioning locks, are properly labeled, and are readily
accessible.
12) The active working area appears to have reached its maximum allowable size. *Please ensure that all waste is
being covered with a minimum of six inches of soil at least once per week or when the active disposal area
reaches ½ acre in size, whichever occurs first.
13) Ground vegetative material is currently being used as cover material. This material should be mixed with soil
at a ratio no greater than 50/50 when used for cover and erosion repair. *Please ensure that ground vegetative
material is mixed at the proper ratio with soil before being used in cover and erosion repair operations.

14) The waste type was reviewed; only Construction & Demolition waste was observed and no unpermitted waste
streams were noted in the active disposal area during this Facility Compliance Inspection.
15) Windblown debris is being well managed at this time.
16) Permanent Edge of Waste Markers are in place around the footprint of the landfill and are being maintained
as required.
17) Leachate seeps were observed on the northwestern sideslope. The presence of wetlands-type vegetation in
these areas suggest that these seeps have been occurring for some time, however, no leachate was observed
leaving the permitted disposal boundary. *Within thirty days of receipt of this Facility Compliance Inspection
Report, please repair all areas which were observed to be seeping leachate. All repaired areas should be
graded at a slope not greater than 3:1, seeded, and mulched to establish a groundcover suitable to prevent
erosion of your landfill cap system.
18) Extensive erosion was observed in various areas on the outside slopes of Phase II. The landfill cap system has
eroded down to the waste in many areas along the northern and northwestern sideslopes. *Within thirty days
of receipt of this Facility Compliance Inspection report, please repair all eroded areas by filling, grading at a
slope not greater than 3:1, and mulching and seeding to establish a groundcover suitable to prevent erosion.

19) The outside slopes of Phase II have a sparse cover crop of native warm season grasses and mixed coppice-
type vegetation. *Plans need to be underway for the seeding and mulching of all outside slopes and inactive
areas of the landfill to establish a groundcover suitable to prevent erosion of your landfill cap system.
20) Some small trees and other woody vegetation were observed growing on the outside slopes on the western
end and the southern sideslope of the landfill. *Please remove all trees and other undesirable woody
vegetation from the outside slopes of the landfill. All outside slopes should be maintained free of brush and
woody vegetation. The cover crop should be mowed as necessary throughout the growing season to ensure
that trees or other undesirable woody vegetation does not become established on the landfill sideslopes.
21) Phase I was not reviewed during this Facility Compliance Inspection. Phase I will be reviewed during the
follow up inspection which will be conducted to inspect the actions taken in response to this Facility
Compliance Inspection Report.
22) *Corrective measures are required as a result of this Facility Compliance Inspection.
