OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0836 (a) states: No person, shall establish on his land, or allow to be established on his land, a septage detention facility, unless a permit for the facility has been obtained from the Division or the facility is operating in accordance with a NPDES permit issued by the NC Division of Water Quality.
On September 23, 2016, Mountain Septic Service was in violation of 15A NCAC 13B .0836(a) in that a septage
detention facility was established on your property without a permit issued by the Division.
On September 23, 2016, four 250 gallon plastic Intermediate Bulk Containers (IBC) totes were observed at 482 John Teague Road, Franklin, NC. One tote was full and the other were empty but three contained residual septage material.
On February 1, 2017, the totes were observed to be empty. The violation is resolved.

ADDITIONAL COMMENTS
1. All Photographs were taken on February 1, 2017 by Troy Harrison.
2. The tanks observed on September 23, 2016 were observed still on site but empty.
3. Three additional steel tanks were observed on site. No waste was observed in the tanks. Mr. Raby stated that he was in the process of completing the permitting application. Using a laser range finder the distance to the
edge of the road was 84 yards. The distance to the nearest property boundary was 60 feet. The distance to the
nearest house was measured to be 108 feet. The location of the nearest well was approximately 210 feet (measured using Macon County GIS). GPS readings were taken on the four corners of the facility using a Trimble unit. One of the tanks was formerly used by Morgan Septic & Pumping Service (SDTF-50-03) which
listed a capacity of 4,500 gallons.
4. The facility cannot be used until a permit has been issued for use.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
