Dear Mr. Toepfer:

The North Carolina Division of Waste Management, Solid Waste Section (Section) has reviewed the
Permit to Construct Waiver Request (DIN 27360) submitted on February 3, 2017 for the CCR Landfill at
the L.V. Sutton Energy Complex. The request concerns Permit Condition Attachment 3, Part 1, #11
which requires a licensed geologist be present to supervise the installation of groundwater monitoring
wells. Duke requests a waiver from this requirement. In lieu of the requirement, Duke will have a
Professional Geologist (P.G.) on call during drilling activities. A field technician, under the supervision of
a P.G., will be present throughout the drilling activities. The Section grants the waiver request.
