PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: Not Applicable OBSERVED VIOLATIONS: 15A NCAC 13B .0402 OPERATIONAL REQUIREMENTS “Any person who maintains or operates a transfer facility shall maintain and operate the facility in conformance with the following practices unless otherwise specified in the permit.” The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility was visited so as to perform the annual Comprehensive Inspection. Unknown to the inspector, Waste Industries suspended service due to a winter storm event that took place several days prior (January 6th and 7th). 2. Maintenance staff were on-site, albeit minimal. 3. Although hauling had not occurred since January 6th, waste was observed in the loading bay. Part of this waste was covered in ice and snow, indicating it had not been removed at the end of the January 6th operating day. This is in violation of the aforementioned rule, as Part VI, #24 (page nine) of the Permit To Operate (DIN 20613) states: “The facility must not cause nuisance conditions. a. The tipping floor and transfer trailer loading area must be maintained in a clean, sanitary condition at all times and must be cleaned at least daily in accordance with the approved Operations Manual. (DIN 20615). b. Waste must only be deposited on a “tipping floor” or directly into a transfer container. Waste must not be stored on the “tipping floor” after operating hours.” Waste is required to be in containers (i.e.: roll-off, trailer, etc.) and the facility cleaned at the end of the operating day. While it is understandable staff needed to alter services/schedules to avoid potentially hazardous travel conditions, media outlets warned of the approaching ice/snow event several days in advance. The shut-down should have included proper waste handling at the end of the day’s operations. Facility staff need to be familiar with the PTO, operations plan, and contingency plans for this facility. Failure to follow the permit and approved plans in the future could lead to the issuance of a Notice of Deficiency and/or a Notice of Violation(s).
