The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. All wastes are taken to the Foothills MSW Landfill in Lenoir. 3. Waste screening records were reviewed. Waste screening at the transfer station is done three to four times each week. Figure 1: Site Map 81-03T Rutherford Co. Transfer Station ADDITIONAL COMMENTS: FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 5 5. The access road is maintained in good condition. 6. A small amount of wind-blown litter around the transfer station was actively being collected during this inspection. 7. Wastes were being accepted at the transfer station at the time of the inspection. 8. Permit, hours of operation, and materials acceptance signage at the facility entrance prominently displayed & legible. Monday - Friday 7:30 – 4:00 Saturday 7:30 – 12:30 1. The transfer station currently receives approximately 130 tons/day. 2. The transfer station’s service area is limited to Rutherford County. 3. Waste is transported from the transfer station by Republic Services of North Carolina, LLC (d.b.a .GDS) who has subcontracted the actual transportation of the wastes to K.R. Drenth Trucking Inc.(KRD). 4. KRD transports all of the wastes to the Foothills MSW landfill (Permit 14-03) in Lenoir, NC. 5. Random waste screenings are done approximately three times a week. Unacceptable wastes were documented and removed. Records are maintained in Mr. Kilgo’s office at the facility. 6. At the time of the inspection, no unacceptable wastes were observed. 7. The of the transfer station were actively receiving waste during the inspection. 8. The southern bays of the transfer station are used to accept co-mingle recyclable materials (Photo #1) from various solid waste collection sites in the county; and from participating municipalities in the county; and from businesses in the county. A leachate capture drain runs completely across the entrance of the two bays of the transfer station. The tipping floor slopes back from the receiving bay to this drain and the concrete apron at the entrance to all bays also slopes to this drain. (Photo #3) 1. Leachate from the transfer station operations is discharged directly to the Town of Spindale municipal sanitary sewer system. 11. Windblown litter was actively being collected at the time of the inspection. (Photo #5) 12. The interior walls, as well as the walls of the receiving bay, are clean and well maintained. 13. Municipal water is available at the site to facilitate fire response. There is a fire hose inside of the entrance to the transfer station. (Photo #6) 14. On-site fire extinguishers are service by Falcon Fire and Safety, of Boiling Springs, NC. 15. Fire response is provided by the Rutherfordton Fire Department. 16. The facility has proper signage at the entrance and the site is properly secured with a locking gate and fence. (Photos #5 & #6) Other Permitted Activities: 17. White goods, scrap metal, and electronics are stored on a concrete pad with a push-wall, west of the entrance to the transfer station. This area was well maintained. (Photo #7) 18. Omni-source removes all CFCs (refrigerant gases) from any of the white goods that have CFCs. 19. Used computers & other electronic equipment are collected and stored outside of the transfer station. (Photo #7) Electronic Recyclers International, Inc. (ERI) out of Baden, NC collects all electronic materials for recycling. 5. Scrap Tires are collected and stored on site in three semi-trailers that are staged north of the landfill offices. Scrap tires are taken to the US Tire facility in Concord, NC. This area was well maintained. (Photo #8) 21. Used oil is collected and stored in an above ground storage tank located outside (to the west) of the transfer station. Heritage-Crystal Clean LLC out of Concord, NC collects the used oil for recycling. (Photo #9) 22. Treatment & Processing (Wood Grinding) of land clearing waste and wooden pallets (restricted to pallets that are made of unpainted and untreated natural wood) is done on the strip of land located south of the C&D landfill and north of the closed MSW. This area was well maintained. The mulch is used on-site for landscaping and erosion control. (Photo #10) Grinding of these materials is done is done two to three times a year by the outside contractor with the lowest bid.
