PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate No. 2909-LCID-2013, Attachment 2, Conditions of Permit to Construct, Part I, facility specific condition 3.d. states, “The disposal unit boundary must be accurately identified with permanent markers.” Permit to Operate No. 2909-LCID-2013, Attachment 3, Conditions of Permit to Operate, Part I, facility specific condition 7 states, “The permanent markers that accurately delineate the waste disposal boundary must be maintained.” Ellen Veach and Mike Phillips are in violation of 15A NCAC 13B .0203(d) for failing to install and maintain permanent edge of waste markers. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 An inspection of the facility revealed that no permanent edge of waste markers were in place. The requirement for permanent edge of waste markers had been noted during two previous inspections on February 22, 2016 and on April 19, 2016. At the time of this inspection, Mr. Phillips stated that no edge of waste markers had been installed at the facility. To achieve compliance, Ellen Veach and Mike Phillips must accurately identify the waste boundary and install and maintain permanent edge of waste markers. 2. 15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate No. 2909-LCID-2013, Attachment 3, Conditions of Permit to Operate, Part I, facility specific condition 8 states, “Excavation, grading and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical foot (3:1). Ellen Veach and Mike Phillips are in violation of 15A NCAC 13B .0203(d) for failing to maintain excavation, grading and fill material side slopes at a ratio that does not exceed 3:1. Upon inspection of the working face, the fill slope exceeded a ratio of 3:1, and appeared to be almost straight up and down. To achieve compliance, Ellen Veach and Mike Phillips must regrade the fill slope to achieve and maintain a ratio that does not exceed 3:1. 3. 15A NCAC 13B .0566(4) states: “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” Ellen Veach and Mike Phillips are in violation of 15A NCAC 13B .0566 by failing to adequately cover waste monthly. During the inspection, the working face was observed to be very large. Mr. Phillips stated that the waste had not been covered since November, when the current contractor began delivering waste to the facility. To achieve compliance, Ellen Veach and Mike Phillips must immediately cover all exposed waste with 12” of suitable soil and ensure that waste is covered at least monthly. 4. 15A NCAC 13B .0566(3) states: “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” Ellen Veach and Mike Philips are in violation of 15A NCAC 13B .0566(3) for failing to restrict solid waste to the smallest area feasible. During the inspection, the large, uncovered working face had not been adequately compacted and appeared to be very loosely piled in areas. Mr. Phillips stated that the working face had not been covered in more than a month. To achieve compliance, Ellen Veach and Mike Phillips must restrict solid waste into the smallest area feasible and establish a working face that can be continuously maintained and adequately covered at least monthly. The facility is a land clearing and inert debris (LCID) landfill, permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, insert debris such as unpainted rock, brick, concrete and concrete block, and used asphalt, in accordance with NCGS 130-294(m). 2. The facility operates by appointment only, and is permitted to receive waste generated within Davidson and Forsyth Counties. The facility was not open at the time of this inspection. 3. The facility is secured by a locked gate and is posted with proper signage. 4. The facility mines soil, and the mined area is being used as the LCID landfill area. 5. The facility is inspected by the Division of Energy, Mineral and Land Resources (DEMLR). 6. The sediment basin appears to be overgrown and not maintained adequately to ensure proper functioning. 7. Vegetative debris is placed adjacent to the working face and spread out for drying if necessary. At the time of this inspection, a large amount of material had been accumulated at the top of the working face. Ensure that accumulated waste is pushed onto the working face regularly, and as soon as possible after being received. 8. Screening and crushing equipment is installed onsite. The facility crushes concrete, screens top soil and soil used for cover, and stores these processed materials, along with soil mixed with inert debris, at the site. 9. The concrete driveway entrance and heavy metal grate at the end of the concrete pad, designed to remove soil and debris from truck wheels prior to exiting the site, appear to be functioning effectively. No mud or debris was observed on the roadway at the time of this inspection. 10. At the time of this inspection, the working face was very large. None of the waste was covered. (See violations listed above for additional information.) 11. Cover all exposed waste immediately and ensure that at least one foot of suitable soil cover is applied at least monthly (every 30 days) or when the active landfill area reaches one acre in size, whichever occurs first. (See violations listed above for additional information.) 12. The slope of the current working face was observed to be near vertical at the time of the inspection. In order to prevent fire, achieve maximum compaction, and allow the safe operation of equipment on the working face, ensure that the excavation, grading and fill material slopes do not exceed a ratio of 3:1. (See violations listed above for additional information.) 13. Soil mixed with inert materials is stored on the east side of the entrance drive prior to segregating materials and The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please ensure that all stockpiles (processed and unprocessed materials) are graded to prevent ponding at the base. 14. Large logs are being stored on the site prior to being processed elsewhere into lumber. 15. Open burning of land clearing waste is prohibited at the site. 16. Ensure permanent markers that accurately designate the waste disposal boundary are installed and maintained, as required by PART I, facility specific condition 7 of the Permit to Operate. (See violations listed above for additional information.) 17. Ensure that the mined area and the base of the working face are properly graded so as not to collect water. 18. Ensure that the unacceptable waste and windblown trash is collected throughout the site during each work day and that prohibited materials, including trash, tires, construction and demolition waste, etc., are segregated and stored, if necessary, in covered containers prior to removal to a permitted disposal facility. 19. It is suggested that areas of the site be graded and designated for the staging of materials requiring separation or processing as they arrive onsite. 20. Mr. Phillips confirmed that the site would remain available for use as a temporary disaster debris storage site (DS29-006). 21. Solid Waste Section will perform additional inspections to ensure that these violations are resolved and compliance is achieved. Unacceptable waste mixed with concrete. Incidental prohibited materials (metals, wood, plastics) scattered around unprocessed waste stockpiles. Prohibited wastes segregated from incoming loads.
