Under N.C.G.S. § 130A-294 (b2)(2) and 295.3 the agency will be conducting a review to determine LENOIR COUNTY’s past compliance with federal and state laws, regulations, and rules, including permit conditions, for the protection of the environment or conservation of natural resources. Compliance Review I looked up the latest PTO issued April 2, 2012 (DIN 16373) for 5403‐CDLF active CDLF over closed MSWLF and Lenoir County is technically in violation of a permit condition found in: Attachment 3 Conditions of Permit to Operate Part I: Operating Conditions Item 1. b. “ The permittee must submit to the Section no later than December 2, 2016 a Corrective Action Evaluation Report to demonstrate the effectiveness of the implemented corrective action program in accordance with Rule 15A NCAC 13B .0574(4)© and the approved Corrective Action Plan (Attachment 1, Part II, Document No. 4). As Ming stated, we can address this during the next permit cycle, however, just want everyone to know the facility does appear to have a permit violation. Appear to be Following the approved WQMP and there are no exceedances of any constituents being analyzed for. 5403‐ active CDLF over closed MSWLF. They appear to be following the approved WQMP however, in the latest sampling report, they have historically elevated concentrations of vinyl chloride, a first time detection of tetrachloroethene, and historically elevated concentration of mercury. They owe us the next CAER Corrective Action Effectiveness Report as of April 2016 (it is a permit condition to submit a CAER every 5 years). I will email them and ask for them to submit a CAER to me.
