The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. All photographs were taken by Troy Harrison on November 14, 2016.
2. The current permitted facility consists of one steel, 10,000 gallon, above ground tank that has been drained and
removed from service.
3. The following was observed under construction: two 8,000 below ground concrete tanks; two 8,000 gallon above
ground steel tanks and one 10,000 gallon steel tank for a total storage capacity of 42,000 gallons. A permit
application has been submitted to the Solid Waste Section. A permit must be received before the new tanks can be placed in use.

4. For SDTF facilities that have a capacity in excess of 25,000 gallons the setback requirements are twice the minimum distance of smaller facilities. Based on Cleveland County GIS and staff information, the facility will
meet the increased setback requirements.
5. New coordinates (taken using a Trimble unit) are: 35.27249o N latitude and -81.59534o E longitude.
