OBSERVED VIOLATIONS:
15A NCAC 13B .0841 (e) states in part: “Each detention and treatment facility shall be designed, constructed, and
maintained in such a manner as to:
(1) Prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground
surface, or into any surface waters;”
Rhea’s Septic Tank Service was in violation of 15A NCAC 13B .0841 (c) because the 8,000 gallon tank observed to have
multiple holes and extensive rust damage with evidence of a past leaks on the side.
In order to come into compliance, Rhea’s Septic Tank Service must immediately cease use of the tank and remove
all waste from the 8,000 gallon tank. By January 13, 2017, submit verification that the 8,000 tank has been emptied and whether it is to be repaired or taken out of service to:

ADDITIONAL COMMENTS
1. The Septage Detention and Treatment facility (SDTF) consisted of two 2,000 gallon steel tanks, one 4,000 gallon steel tank and one 8000 steel tank above tanks for storage and treatment of domestic septage.
2. All photographs were taken by Troy Harrison on September 29, 2016.
3. Set-back/buffer requirements appear to have been met.
4. Appropriate signage (No Trespassing signs) is posted for the site. 5. All weather roads are maintained for access to the site.
6. The 2,000 gallon tanks appeared to be structurally sound. The 4,000 gallon tank had evidence of a previous single leak that appears to have been repaired. The 8,000 gallon tank was observed to have
multiple open holes and extensive rust damage with evidence of a previous leaks on the side. Tanks that have any area below the entrance where leaks may occur cannot be used and must be emptied.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

8. No objectionable odors were observed in the area around the tanks.
