STATUS OF PAST NOTED VIOLATIONS:
15A NCAC 13B .0839 states: (a) Each permit holder shall maintain a log which includes at least the following information for each septage pumping event:
(1) The date, type, quantity, and location of septage pumped; (2) Location of the discharge of the septage.
(b) A septage management firm shall make all records required in accordance with this Section or conditions of the permit available for inspection by a representative of the Division at the time and place of an inspection of the firm's septage
pumper truck(s) or upon request.
On June 9, 2015, River’s Edge Marina was in violation of 15A NCAC 13B .0839 because log records for each
septage pumping event was not being maintained. On August 31, 2016 the company was not keeping a log of septage pumped. The violation is not resolved.

ADDITIONAL COMMENTS
1. The detention tank is located behind a privacy fence with a gate and latch to prevent unauthorized access.
2. This facility consists of a 325 gallon tank for the storage of domestic septage discharged from boats that are not being used as permanent residences.
3. Clear access was maintained to the tank.
4. No offensive odors were observed.
5. No evidence of leaks were observed.
6. The tank appeared to be structurally sound.
7. Operational records were not available.
8. M. Colman Hull is no longer with the company. The current permit is issued to River’s Edge Marina and M. Coleman Hull. A permit revision will need to be issued to reflect that change.

administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
