Main St Waynesville, NC 28786 PARTICIPANTS: John Preston, Santek Environmental of North Carolina, LLC (12/20/2016) Kevin Gregg, Santek Environmental of North Carolina, LLC (01/04/2017) Lee Hill, NCDEQ – Solid Waste Section STATUS OF PERMIT: Original Permit to Construct: July 22, 1992 Original Permit to Operate: October 8, 1993 Permit Amendment /Modification PTC Phase 3: May 5, 2009 Permit modification – Santek Environmental of North Carolina, LLC as facility operator – November 28, 2011 Current Permit to Operate issued on December 11, 2014 PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 OBSERVED VIOLATIONS: 15A NCAC 13B .1626(1)(g)(ii) Resolved “Waste placement at existing MSWLF units designed and constructed with a base liner system permitted by the Division prior to October 9, 1993 and approved for operation by the Division shall be within the areal limits of the base liner system and in manner consistent with the effective permit.” During the December 20, 2016 inspection, rock that had been removed from an access road within the landfill footprint was observed stored outside the areal limits of the base liner system in the soil borrow area of the facility. Soil and waste was observed mixed within the rock. Haywood County and Santek Environmental of North Carolina, LLC are in violation of 15A NCAC 13B .1626(1)(g)(ii) in that, during the December 20, 2016 inspection waste was observed placed outside the areal limits of the base liner system. On the afternoon of December 20, 2016 facility staff sent pictures showing where the rock, trash and soil had been removed from the soil borrow area of the facility and had been placed inside the footprint of the lined landfill unit therefore, the violation is resolved. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 7 ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on December 20, 2016 and January 4, 2017 unless otherwise noted. 2. The facility is owned by Haywood County and is operated by Santek Environmental of North Carolina, LLC. 3. The service area for the facility is Avery County, Buncombe County, Burke County, Cherokee County, Clay County, Graham County, Henderson County, Jackson County, Macon County, Madison County, McDowell County, Mitchell County, Polk County, Rutherford County, Swain County, Transylvania County, and Yancey County. 4. The facility is open to the public Monday through Saturday 7:30am to 3:30pm. 5. The facility is secured by a gate and proper signage was observed at the entrance to the facility. Records Review 6. The review of records occurred on December 20, 2016. 7. The current permit and operations plan were available upon request. 8. Waste screening forms from January 2, 2016 to December 19, 2016 were available for review. The facility conducts three waste screenings per day. Waste screenings appear to be performed with good frequency and showed final disposition of certain banned items. The facility accepts yard waste. On all waste screening forms where loads are identified as containing yard waste, ensure that it is noted that yard waste was diverted to the “Mulching and Grinding Treatment and Processing” area. 9. Prohibited waste training was performed on June 16, 2016 and written acknowledgement of training by facility personnel was provided by email on December 20, 2016. 10. Methane monitoring is being conducted on a quarterly basis and records were available for review. Environmental Monitoring Services, LLC conducts methane monitoring at the facility. 11. Methane monitoring was conducted on 2/11/2016, 5/10/2016, 8/2/2016 and11/3/2016. No exceedances were noted. 12. Groundwater monitoring reports for October 2015 and April 2016 were reviewed. All reports had exceedances reported above the 2L level. 13. Leachate testing is being conducted concurrent with groundwater sampling. Leachate hauling and maintenance records were available for review. The last leachate line cleaning occurred in August 2012. Leachate is taken to the Town of Waynesville Waste Water Treatment Plant for treatment. The Industrial User Pretreatment agreement with the Town of Waynesville was available for review. 14. Records for asbestos waste were available for review. These records included the latitude and longitude of the area of the landfill where the asbestos was placed. It is recommended to record the elevation where the disposal of asbestos waste occurred. 15. Tonnage reports from July 2015 to present were reviewed. The facility received 160,499.58 tons of MSW waste from July 2015 to June 2016 which is within the maximum variance allowed by GS 130A-294(b1)(1) of the permitted amount of 146,000 tons. Operations Inspection of MSWLF Unit (44-07) 16. During the December 20, 2016 inspection, rock that had been removed from an access road within the landfill footprint was observed stored outside the areal limits of the base liner system in the soil borrow area of the facility. Soil and waste was observed mixed within the rock. Please see observed violations section of this report. 17. Windblown litter was observed on the top and side slopes of the landfill during the December 20, 2016 inspection; however, minimal windblown material was observed outside the active landfill unit. Please note per 15A NCAC 13B .1626(11)(c), “At the conclusion of each day of operation, all windblown material resulting from the operation shall be collected and returned to the area by the owner or operator.” 18. Litter and/or flagging was observed on the top of the landfill during the December 20, 2016 inspection. 15A NCAC 13B .1626(2)(a) states in part, “the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging. 19. No unapproved material was observed on the working face of the landfill. 21. The leachate lagoon is located to the northeast of the landfill. The liner was observed and no visual deficiencies were noted. 22. Edge of Waste Makers were installed and were clearly visible. 23. Additional soil had been added to the side slopes between the December 20, 2016 and January 4, 2017 inspections. 24. The windblown litter issues observed during the December 20, 2016 inspection had been corrected on January 4, 2017. Please continue to return windblown material to the working face at the end of each day. 25. Groundwater monitoring wells MW-1, MW-2, MW-2D, MW-3R, MW-3DR, MW-4A, MW-8, MW-11S, MW- 11D, MW-14, MW-15, MW-16 and MW-17 were observed on January 4, 2017. All wells were locked, labeled and paths to the wells were being maintained. Operations Inspection of Mulching and Grinding Treatment and Processing Area 26. The Mulching and Grinding Treatment and Processing Area was inspected on December 20, 2017. 27. The facility accepts unpainted, untreated wood, brush, and unpainted/untreated pallets for grinding. 28. The Mulching and Grinding Treatment and Processing Area is located to the south of phase 2 of the MSW landfill and located to the east of the closed construction and demolition landfill. 29. The ground material is mixed with soil and used as approve Alternative Daily Cover (ADC). 30. No unapproved material was observed during the December 20, 2016 inspection. Operations Inspection of Closed CDLF (44-07) 31. The closed CDLF unit was inspected on January 4, 2017. 32. The facility stopped receiving waste on June 30, 2008. 33. Edge of Waste (EOW) constructed of a T-Posts and a sign were installed and easily visible at the time of inspection. 34. The landfill had good vegetative coverage and appears to be mowed on a regular basis. 35. Some small woody vegetation was observed near the drainage berms on the landfill cap. Please mow and remove the woody vegetation from the drainage berms. 36. No standing water or settling was observed on the cap.
