OBSERVED VIOLATIONS:
1. 15A NCAC 13B .1626(2)(a) states: “Except as provided in Sub-Item (b) of this Item, the owners or operators of all
MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or
at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging.”.
During the inspection of cell 1 & 2 an area slightly southwest of the working face was observed to have inadequate
cover. Facility staff stated that the area was last covered at least two days prior to the inspection. Due to wet weather
conditions adequate cover would be placed in this area by Friday January 6, 2017.
Cleveland County was in violation of 13B .1626(2)(a) for failure to cover disposed solid waste with six inches
of earthen material at the end of each operating day at the MSW landfill. Facility staff provided
photographic documentation on Friday January 6, 2017 via email showing adequate soil was applied to
exposed waste located southwest of the working face of the landfill, therefore the violation is considered to be
RESOLVED.

ADDITIONAL COMMENTS
1. Proper signage was observed at the entrance of the facility.
2. The facility is permitted to receive solid waste generated within Cleveland County.
3. The Self-McNeilly facility accepted an average 270.55 tons per day for fiscal year 2015-2016. (July 2015-June
2016). For fiscal year 2016-2017 the facility has accepted an average of 135.36 tons per day. (July 2016-
December 2016).
4. The C&D Landfill accepted an average of 175.27 tons per day for fiscal year 2015-2016. (July 2015-June
2016). For fiscal year 2016-2017 the facility has accepted an average of 93.24 tons per day. (July 2016-
December 2016).
Operations Inspection of the MSW Landfill Unit:
5. The facility is currently working in Phase 1 & 2.
6. No unacceptable waste streams were observed in the MSWLF. Three tires had been pulled out and set aside to
be moved to the tire collection area.
7. Edge of liner markers were observed. Edge of waste is placed no closer than four feet from the edge of liner.
8. Soils were extremely wet at time of inspection, however all access roads maintained in good condition.
9. Working face was small and compact.
10. The facility utilizes soil and spray-applied Mortar Coating (SMC) for daily cover. During the inspection soil
was being applied as daily cover to a portion of the working face. Other than the area cited in the observed
violations section of this report, the daily cover at the facility looked good. `
11. Slight amount of windblown waste was observed at toe of slope south of working face. Material captured by
wind fence. Waste observed appeared to be no more than from daily activities. Windblown waste was being
collected during the inspection.
12. Perimeter slopes seeded with good germination of seed. Some slight surface erosion observed on east side near
SW corner. One spot of significant erosion observed on east side causing vegetation and compost to wash from
soil. No exposed waste. Need to repair eroded areas and continue work to existing groundcover sufficient to
restrain erosion.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

Records Review
13. During the inspection while reviewing the permit and operational plan it was pointed out to facility staff they
did not have a current copy of the permit and operational plan. Facility staff was shown where to go online to
obtain current copies which were printed and placed in the file.
14. Training records were reviewed.
15. 2nd Semi-annual groundwater monitoring dated 12-2-15 was reviewed. Surface water and leachate monitoring
reports were reviewed. Leachate monitoring is performed semi-annually with their groundwater monitoring.
16. Methane monitoring was being performed as required. Reviewed 2nd quarter 2015, 3rd quarter 2015, 4th quarter
2015, 1st quarter 2016, 2nd quarter 2016, 3rd quarter 2016, 4th quarter 2016.
17. Random inspection reports were reviewed. Facility staff perform an average of three (3) random inspections
each day at MSW and CDLF. Screening performed with good frequency. Good documentation of observed
unacceptable waste streams and final disposition of these waste. Records reviewed were from July 1 2016 –
December 31, 2016.
18. Leachate is discharged by a force main to the City of Shelby WWTP. It is pumped via force main eight (8)
times every twenty-four (24) hours for a duration of thirty (30) minute each time.

C&D Landfill Unit
20. Edge of liner markers were observed. Edge of waste is placed no closer than four feet from the edge of liner.
21. No prohibited wastes were observed during the inspection.
22. All access roads maintained in good condition.
23. Working face less than ½ acre in size.
24. The facility utilizes soil for cover which is applied weekly.
25. No on-site erosion of the landfill was observed.

26. No ponding of water on the landfill was observed.
27. Minimal windblown waste observed east of working face. Facility staff noted and will be picked up by end of
working day.
White Goods & Scrap Metal Collection Area
28. White goods and scrap metal are collected from the public at each of the County’s nine convenience centers.
Cleveland County then hauls the white goods and scrap metal to a staging area located NW of the two leachate
above ground holding tanks.
29. All metal is placed on a concrete pad.
30. Area is well maintained. Materials behind wall that fall off pile during pushing up were pointed out to facility
staff.
31. CFC’s are removed from all white goods by Rapid Recovery.
32. One lawnmower battery behind wall needs to be removed. Facility staff removed lawnmower battery and
relocated all material behind walls onto the concrete pad and e-mailed photos documenting removal on 1-6-17.
Scrap Tires
33. Scrap tires are collected and stored in semi-trailers.
34. Area is well maintained.
Treatment and Processing Area
35. Pallets and land clearing debris maintained in separate stockpiles.
36. All material was recently ground.
37. Only a small amount of unground material on site.
38. Area well maintained.
Compost Area
39. Located adjacent to maintenance building.
40. Material (leaves) maintained in windrows.
41. Good access around windrows and finished pile for access by firefighting equipment.
42. Temperature records reviewed.

43. Need to address areas of ponding. Grade or fill as needed. Facility experienced heavy rains Monday and
Tuesday of this week.
