Mulch and More Gary Gibbs, Retail Operations Manager, Hensons’ Inc. Mulch and More STATUS OF PERMIT: Active. Permit No. 11-09 Large Type 1 Compost Facility. (PTO in renewal process.) PURPOSE OF SITE VISIT: Comprehensive Facility Inspection. STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. On site for comprehensive facility inspection and to discuss Permit To Operate (PTO) application renewal with Perry Suggs, Hydrogeologist, Solid Waste Section and with Hensons’ Inc. representatives. As required, the facility submitted the PTO application renewal prior to February 12, 2016. The PTO application renewal is currently under review. 2. The facility is approved to accept land clearing debris, wood pallets, and yard trash. No unacceptable waste streams were observed during this inspection. 3. Access roads were in good condition and site access was controlled. 4. Sediment basins and erosion control measures at the facility appeared to be maintained and functional. Continue efforts to maintain the facility to prevent the accumulation of stormwater or leachate on travel areas or active composting sites. 5. All buffers and setbacks appeared to be maintained at the facility during this inspection. (Special note: Buncombe County government regulates activities in the flood plain adjacent to this site. A development permit for this facility has been issued by Buncombe County (Permit Application renewal submittal DIN #25988) to allow for storage of commercial mulch along the floodplain fringe. Per the Buncombe County Zoning Ordinance, this parcel is in an EMP (Employment) zoning district and this facility’s operations are considered an existing non-conforming use. Existing non-conforming uses do not require special approval in order to continue operations (see letter dated December 29, 2016, Exhibit D, Permit Application submittal DIN #25988). 6. Temperature records from July 6, 2015 through December 28, 2016 were reviewed on site during the inspection. All temperature records appeared to be in compliance with the Type 1 material management requirements. 7. Wastes received and product stored appeared to be in reasonably sized piles with adequate fire breaks and lanes. Continue to maintain windrows and piles with access lanes for fire control as necessary. 8. In general, the facility appeared to be well operated and maintained.
