PURPOSE OF SITE VISIT: Closure Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. The property was sold to Ranch Properties LLC on September 4, 2015. The facility closure process is being implemented through the current property owner. 2. Access to the site is restricted by means of a gate which is kept locked when the property owner is not at home. 3. Access roads are of all-weather construction and well maintained. 4. The facility had included a mining operation under permit # 79-25. 5. Permanent edge-of-waste markers had been installed at the northwest, northeast and southwest corners of the fill area. The markers are bright orange rebar pins that stand approximately 4’ in height. Each of these three pins was easy to spot and was observed during the inspection. 6. By February 15, 2017, ensure that a fourth permanent edge-of-waste marker is installed at the southeast corner of the fill area to mark the actual location of the outer boundary of the waste that was disposed of in the landfill. 7. No signs of erosion were observed at the site. 8. Due to vehicles entering the site to set the edge-of-waste markers and to access the stone and soil stockpiles, several ruts had formed on the top of the landfill. At the time of this inspection, some water had collected in these ruts from the wind/rain event that had occurred the previous week. By February 15, 2017, perform maintenance to shape the top of the landfill to ensure that surface water is diverted and no water is impounded over the waste, as required by 15A NCAC 13B .0566(10). 9. Woody growth and small trees had been removed from the side slopes, as required during the previous inspection. 10. Preventive maintenance should be undertaken regularly to ensure that woody growth does not become established on the top or the slopes of the landfill, as this could damage the landfill cap and/or inhibit the required established vegetative cover from protecting the fill area and preventing erosion. 11. Please note that inspections of the landfill facility will continue to occur after closure and access must be provided to DEQ staff as requested. 12. Notify Susan Heim at 336-776-9672 when required activities (see #6 and #8 above) are completed so that compliance can be verified and a closure letter issued for the landfill. NOTE: Activities must be completed by February 15, 2017. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
