Dear Mr. Bryant:
The Solid Waste Section (Section) previously issued a letter dated December 8, 2016 instructing New River
Tire Recycling, LLC (New River Tire) to remove material from the S-1 sample location due to arsenic
concentrations exceeding the standards established in 15A NCAC 02L .0202 (2L Standards). New River
Tire subsequently re-analyzed the material from the S-1 location via the synthetic precipitation leaching
procedure (SPLP). Based on the SPLP analytical results, there were no constituents reported at
concentrations exceeding the 2L Standards.
Based on the most recent analytical data, the Section has determined that the material in the S-1 sample
location is suitable for use as beneficial fill. Please contact me at (919) 707-8288 or by e-mail at
