Dear Mr. Divers:
On May 29, 2015 the Division of Waste Management, Solid Waste Section (Section) received
your application for the Permit to Construct, Greater Asheville Regional Airport, Area 2
Engineered Structural Fill Project, located in Buncombe County, entitled:
Project Manual, Greater Asheville Regional Airport – Area 2 Engineered Structural Fill Project,
Asheville, North Carolina. Prepared for Duke Energy. Assembled for Charah, Inc. Prepared by
FSC Consulting. May 2015. DIN 24408.
On June 18, 2015 the Section performed a review of the application for a determination of
completeness and determined the application complete in accordance with North Carolina
General Statute NCGS 130A-309.203(b). The determination of completeness meant that the
application included all required components in accordance with North Carolina General Statute
NCGS 130A-309.215, but did not mean that the required components provided all of the
information that is required for the Division to make a decision on the application. Therefore, the
determination of completeness included a technical review of the application, entitled:
Permit to Construct Application – Determination of Completeness and Technical Review,
Greater Asheville Regional Airport, Area 2 Engineered Structural Fill Project, Buncombe
County. Prepared by NC Solid Waste Section. June 2015. DIN 24514.
Since June 2015 there has been no written response to the information requested in the technical
review and the application has been on hold per conversations with you. On December 20, 2016
in a telephone conversation, you informed me that the project has been cancelled and I informed
you that this denial letter was forth coming. As a result, your application for a permit to
construct and operate a structural fill facility is hereby cancelled.
