The property totals 4.43-acres and is comprised of three parcels. The 2317 Thrift Road parcel (07105114) is approximately 2.82-acres. 2317 Thrift Road was previously utilized as a military base (unknown-late 1930s); Rulane Gas Company vehicle maintenance, carburetor rebuilding shop, and propane storage yard (until late 1940s-1952); Suburban Propane fleet vehicle maintenance (1952-2012). The southern portion of the building is currently occupied by an auto repair facility/U-Haul rental office and hair salon. The 1225 Berryhill Road parcel (07105116) is 0.71-acres. 1225 Berryhill Road was previously utilized as Cities Service Oil Company/American Mineral Spirits bulk plant (1950s-1960s); Cherokee Oil Company (mid-1980s-early to mid-1990s) as a waste oil processing facility. The property is currently cleared land utilized by a landscaping company for storage of equipment and materials (landscape and tree removal). The CSX parcel (07105121) is 0.90-acres. The CSX parcel was previously utilized as a rail spur since at least the 1940s. The property is currently unoccupied. There is known petroleum, PCB, and metal contamination in soil as well as TCE contamination in the groundwater. The applicant PD listed below have asserted that: 1) they have not caused or contributed to the contamination at the property, and 2) they have substantially complied with laws, regulations, and rules for the protection of the environment. If you have any information to suggest otherwise, please provide that information to me at William.schmithorst@ncdenr.gov by December 22, 2016. A Brownfields Agreement (BFA) has no legal effect on your agency's authority to regulate or enforce against any and all parties who caused or contributed to the contamination at the property. In fact, the BFA will require the developer to provide access to the property to any party doing work under any DEQ program. A BFA provides liability protection only to a non-causative redeveloper of the property. The developer will be required to make the property safe for its intended re-use. Cleanup to unrestricted use standards will not be required unless deemed necessary based on the developer's proposed use of the property. Furthermore, the BFA will not change the developer's responsibility to obtain any and all DEQ permits (e.g. storm water, sediment control, NPDES, etc.) as required under applicable law.
