The facility received a closure letter from the Solid Waste Section [Section] on December 21, 1995 which stated post closure conditions. The closure letter Post Closure Condition 1 states: “MANAGEMENT OF LANDFILL GAS: The owners shall take the measures necessary to ensure that the closed site shall continue to meet the design standards for landfill gas found in Rule .0503(2)(a).” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 On December 13, 2016 facility staff emailed results from the October 17, 2016 Landfill Gas Monitoring event. Methane detections above the LEL were observed in three wells: GP-3 (308% of LEL), GP-8 (302% of LEL) and GP-9 (1204% of LEL). GP-9 is a facility boundary well that is located on the southwest side of the facility. On December 15, 2015 the Landfill Gas Monitoring results for monitoring events from October 2013 through May 2016 were sent by email. Exceedances of the Lower Explosive Limit (LEL) were reported in boundary well GP-9 on October 21, 2013, October 19, 2015 and April 26, 2016. Transylvania County is in violation of 15A NCAC 13B .0503(2)(a)(ii) and 15A NCAC 13B .0203(d) in that, during the October 21, 2013, October 19, 2015, April 26, 2016 and October 17, 2016 landfill gas monitoring events, exceedances of the methane LEL at the facility boundary were detected in gas probe GP-9. To achieve compliance, within thirty (30) days of receipt of this letter, Transylvania County must submit a Landfill Gas Remediation Plan for exceedances at the facility boundary, with a timeframe for implementation, to Ervin Lane, Compliance Hydrogeologist. The plan must be implemented as approved. Additional corrective measures may be required, should the plan fail to reduce methane levels at the facility boundary. All photos were taken by Lee Hill on December 7, 2016 unless otherwise noted. 2. The facility is secured by a gate which also secures the Calvert Road Convenience site. 3. The landfill has good vegetative cover and was recently mowed in October. Briars and other woody vegetation have become established on three areas of the cap which are not suitable for mowing with equipment available. The briars and woody vegetation must be removed to prevent damage to the landfill cap. Maintenance on these areas must be completed within 60 days of receipt of this letter. 4. The facility had received over five inches of rain in the 72 hours prior to the inspection. No settling or standing water was observed on the cap of the landfill. 5. Landfill gas is removed by a passive venting system installed on the top of the landfill. 6. Results from the October 17, 2016 Landfill Gas Monitoring event were provided by email on December 13, 2016. Methane detections above the LEL were observed in three wells: GP-3 (308% of LEL), GP-8 (302% of LEL) and GP-9 (1204% of LEL). GP-9 is a facility boundary well that is located on the southwest side of the facility. Due to the exceedances of the methane LEL in boundary well GP-9, Transylvania County must submit a Landfill Gas Remediation Plan within thirty (30) days to Ervin Lane. Please see observed violations section of this report. 7. Pursuant to Solid Waste Management Rules 15A NCAC 13B .0503 (2)(a) - the concentration of explosive gases generated by the site shall not exceed: (i) twenty-five percent of the limit for the gases in site structures (excluding gas control or recovery system components); and (ii) the lower explosive limit for the gases at the property boundary. Because methane gas exceedances are documented at the property boundary, immediate The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Given the right conditions, methane gas has the potential to be a significant public health hazard. The dynamics that influence gas movement and migration vary. Methane gas concentrations can fluctuate widely depending on the conditions at the time they were measured. 8. The groundwater monitoring wells were observed with the exception of MW-107S due to animals which prevented access to the well. The surface casing for MW-3 has been covered with sediment and the sediment needs to be excavated from around the casing to ensure the integrity of the well. 9. The hinges on the MW-3 well cap appear to be failing and need to be replaced to insure the integrity of the well. 10. Facility staff sent pictures on Monday, December 12, 2016 of MW-107S and showing where the MW-3 casing had been dug out, gravel added around the top of the casing and the hinge repaired. If water is observed inside the casing during future monitoring events, more substantial repairs will be needed. 11. Groundwater Monitoring reports from December 2015 (sampling event October 19, 2015) and July 2016 (sampling event April 26, 2016) were available upon request. Exceedances above the 2L standard of Benzene and 1,4-Dichlorobenzene were reported in MW-3 in December 2015 report. The July 2016 report showed exceedances above the 2L standard of Benzene in MW-105D and exceedances of 1,4-Dichlorobenzene were found in MW-3. 12. Edge of waste markers (EOW) are installed and were visible at the time of inspection. Some of the original fiberglass marker posts have been replaced by PVC pipe.
