Re: Comment on a Life-of-Site Permit Application
Lenoir County Transfer Facility
Lenoir County, North Carolina
Permit No. 5405T-Transfer-1998, Document ID No. (DIN) 27169
Dear Mr. Bryan:
The Division Waste Management (DWM), Solid Waste Section (SWS) completes a review of
the permit application for a life-of-site permit (DIN 27163) and has few comments on the permit
application, which are stated below:
1. Please complete, sign, and date the enclosed “Applicant Signature Page.”
2. Please provide the following documents which are not available in the Solid Waste
Section (SWS) file system/record:
a. Zoning approval letter issued by the County of Lenoir.
b. The scaled Facility Plan Drawing(s). The transfer station and recycling units
(scrap/used tires, lead-acid batteries, yard waste, pallets, scrap metals & white goods
as described in Section VI) should be added to the existing Facility Plan drawing(s)
for Lenoir County Landfill Facility. Additionally, the drawing(s) must contain
- The transfer station building layout (90-ft by 100-ft metal building structure,
tipping floor, loading bay area, retaining walls).
- The leachate/wash-down wastewater management system including the location
of the sump in the lower bay, the layout of drain lines inside and outside the
transfer station building, the oil/water separator & leachate holding/ storage tank
and the secondary containment, and/or drain line alignment to the on-site surface
leachate impoundment.

- Waste trailer staging area. And
- Stormwater/surface water drainage features etc.
c. The letter that is issued by the Wastewater Treatment Plan owned by the City of
Kinston approves receiving, treating, and disposing of wastewater generated from the
transfer station.
3. (Sections I & VI) The Operations Plan states that collected wastes will be transferred and
disposed of at Sampson County Landfill (8202-MSWLF-2000) in Section I, but in
Section VI, Paragraph D the disposal site is East Carolina Environmental Regional
Landfill at Bertie County (0803-MSWLF-1993). Please provide the consistent waste
disposal site info.
4. (Section III) The SWS was told that Mr. Miller retired so please provide the new contact
of the facility in this Section.
5. (Sections IV or VI)
a. Please describe the waste-loaded trailer equipped with a device (s) to mitigate wind-
blow litter and leakage such tarps and leak-resistance sorbents according to Rule 15A
NCAC 13B .0105(d).
b. Please describe the approaches to manage and remediate spill or leakage should occur
at the on-site trailer staging area.
6. (Section VI) Please provide additional info or make correction.
a. (Paragraph A)
i. The recycling or miscellaneous waste management units described in this
Paragraph must be shown on the Facility Plan drawing (s) [referring Comment
No. 2b.]
ii. The Lenoir County Land Clearing and Inert Debris Landfill was a closed unit.
Yard waste is prohibited to be disposed of at this unpermitted/closed unit.
According to the SWS record, yard waste shall be stockpiled and
treated/processed at the on-site Small Type 1 Composite Unit (DIN 16373).
b. (Paragraph D) Please use the correct state agency title of North Carolina
Environmental Quality (NCDEQ) instead of NCDENR.
c. (Paragraph E) Describe the holding tank.
i. The position (above ground or underground), material, and capacity/volume
(gallons) of the holding tank.

ii. Is there an alarming system installed inside the holding tank to warn
overfilling the tank?
d. (Paragraph F)
i. The applicable rule shall be 15A NCAC 13B .0402.
ii. The typical random waste screen from/log should be appended to the
Operations Plan.
iii. The shipment will also be examined the “waste for disposal” that is permitted
to receive and dispose of at the permitted landfill facility whose service area
includes the origin of the waste – Lenoir County. Please add this requirement
to this Paragraph.
e. (Paragraph F) Please add the following fire prevention &reporting requirements to
this paragraph.
i. Open burning of solid waste at the facility is prohibited.
ii. Describe how to handle “hot load (s)” occurring in the following conditions:
waste loaded truck is approaching to the scale house, inside the facility, or on
the tipping floor.
iii. Fires must be reported to the regional waste management specialist with 24
hours or the occurrence, followed by a written notification within 15 calendar
days of the occurrence. (The standard “Fire Occurrence Notification Form”
can be used and downloaded from the following link

The form should be appended to the Operations Plan.
7. (Paragraph F) Please provide the Contingency Plan, including, but not limited to:
a. Management of waste activities during the courses of the following natural disasters –
hurricanes, tornados, flooding events, inclement weather conditions or snow storms.
b. Equipment breakdown or long-term power outage.
c. Management of non-conformance (not permitted or hazardous) wastes detected in
the waste screening course; this should include
i. The person(s) or organization(s) are responsible for handle, contain, store,
report, and dispose of the non-conformance waste.

ii. Reporting requirement. (The landfill owner or operator shall notify the
Division within 24 hours of attempted disposal of any waste the landfill is not
permitted to receive, including waste from outside the area the landfill is
permitted to serve.)
iii. The designated location (s) to temporarily store the non-conformance waste at
the facility.
iv. The maximum duration that non-conformance waste can be stored at the
facility.

I understand that North Carolina General Statute 130A-22 provides for administrative penalties
of up to fifteen thousand dollars ($15,000.00) per day per each violation of the Solid Waste
Management Rules. I further understand that the Solid Waste Management Rules may be
revised or amended in the future and that the facility siting and operations of this solid waste
management facility will be required to comply with all such revisions or amendments.
