VAN DER VAART Secretary MICHAEL SCOTT Director May 19, 2016    CERTIFIED MAIL   RETURN RECEIPT REQUESTED     Cooper Septic Tank Service  Emily & Randall Cooper  P.O. Box 645  Wagram, NC  28396      SUBJECT:  Notice of Violation    Compliance Inspection Report    Cooper Septic Tank Service    SLAS 83‐04    Scotland County    Dear Ms. & Mr. Cooper:    On April 8, 2016, Ms. Connie S. Wylie, representing the State of North Carolina, Division of Waste  Management Solid Waste Section, inspected the above referenced facility for compliance with  North Carolina solid waste statutes and rules. During this visit the following violation(s) were  noted:    A. 15A NCAC 13B .0837(a)(7) Septage shall be applied to the surface of the land from a moving vehicle in such a manner as to have no standing liquid or soil disturbance resulting from the waste flow after discharge is complete. Noted a significant amount of puddling & indications of heavy application in a recent spray path during this visit. Called Emily Cooper and was informed that last discharge event occurred approximately one hour prior to this visit which means that the septage was not land applied properly due to the standing liquid.     B. 15A NCAC 13B .0838(c) (1)Domestic septage shall be treated in accordance with the requirements in 40 CFR 503 Subpart D. (2)Grease septage, treated grease septage, commercial or industrial treatment plant septage and commercial/industrial septage shall be treated in accordance with 40 CFR 257.3-6 or treated by an equivalent or Cooper Septic Tank Service  Notice of Violation  Page 2 of 3  May 19, 2016      State of North Carolina | Environmental Quality | Waste Management 1646 Mail Service Center | 217 West Jones Street | Raleigh, 27699-1646 919 707 8200 more stringent process in 40 CFR 503 Subpart D. Permit Condition 6 Domestic septage ph shall be raised to 12 or higher by alkali addition and, without the addition of additional alkali, shall remain at 12 or higher for 30 minutes prior to land application. Grease septage or grease septage mixed with domestic septage, shall be raised to ph 12 or higher by alkali addition and, without the addition of additional alkali, shall remain at 12 or higher for two hours prior to land application. Checked the recent spray path in several areas with litmus paper and the ph was 6 or 7. No indication that any lime was added to this septage load.       Based upon the foregoing, Cooper Septic Tank Service shall come into compliance by June 17,  2016 with all requirements of the regulations in 15A NCAC 13B .0837(a)(7) and .0838(c) by  completing the following:    1. Ensure every time septage is land applied that adequate truck speed, pressure and a spreader attachment are being utilized to discharge in a wide thin spray path. Also the truck shall be in motion when the discharge begins.     2. Implement changes to ensure that adequate lime stabilization is obtained per Rule .0838(c) – obtain ph 12 and hold for the required amount of time. The ph should be checked again on site prior to the start of the discharge event and if ph 12 is not present then land application shall not occur at that time.     3. Cooper Septic Tank Service shall provide a written certification with supporting  documentation on company letterhead confirming the noted compliance schedule has  been completed.  Include in this certification any actions taken to prevent these  violations from occurring in the future.  Mail this certification to Connie S. Wylie,  NCDEQ, Division of Waste Management, Fayetteville Regional Office, 225 Green Street,  Suite 714, Fayetteville, NC 28301 by June 17, 2016.      The violation(s) listed above were observed by Section staff and require action on behalf of the  facility in order to come into or maintain compliance with the Statutes, Rules, and/or other  regulatory requirements applicable to this facility.  Be advised that pursuant to N.C.G.S. 130A‐22,  an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid  Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the  N.C. General Statutes.  Further, the facility and/or all responsible parties may also be subject to  enforcement actions including penalties, injunction from operation of a solid waste management  facility or a solid waste collection service and any such further relief as may be necessary to  achieve compliance with the North Carolina Solid Waste Management Act and Rules.      Cooper Septic Tank Service  Notice of Violation  Page 3 of 3  May 19, 2016      State of North Carolina | Environmental Quality | Waste Management 1646 Mail Service Center | 217 West Jones Street | Raleigh, 27699-1646 919 707 8200   Please keep me informed of your progress in this matter.  Solid Waste Section staff will conduct  a follow‐up inspection(s) to verify that the facility has completed the requirements of this Notice  of Violation.    If you have any questions please contact me at (910) 433‐3352 or email   connie.wylie@ncdenr.gov.    Sincerely,        Connie S. Wylie  Soil Scientist  Division of Waste Management ‐ Solid Waste Section    copies:  CLA Branch Head  Compliance Officer
