Land Use Restrictions Update to the North Carolina Department of Environment and Natural
Resources (“DENR”)as required by the Brownfields Agreement between Wendover and
DENR.

C.Richard Vaughn,Jr.,being duly sworn,hereby deposes and says:
1.I am C.Richard Vaughn,Jr.,Member/Manager of Wendover Village,LLC (“Wendover”).
2.Wendover is the Prospective Developer under that certain Brownfields Agreement between
Wendover and the North Carolina Department of Environment and Natural Resources
(“NCDENR”)last dated February 21,2003 (a copy of which is attached as Exhibit A to the Notice
of Brownfields Property recorded in Book 5751,Page 2110 of the Guilford County Register of
Deeds)(the “Brownfields Agreement”).
3.This Land Use Restriction Update is submitted in accordance with the provisions of Paragraph
10.a.vi.of the Brownfields Agreement and by agreement of the property owners contained in
Paragraph 17 of the Declaration Of Covenants,Conditions and Restrictions For Wendover Village
(which is recorded in Book 5876,Page 2545 of the Guilford County Register of Deeds).
4.Wendover certifies to NCDENR that the above mentioned Notice of Brownfields Property
containing the land use restrictions set forth in the Brownfields Agreement remains on recorded
with the Guilford County Register of Deeds;that such land use restrictions are being complied
with;and that any caps installed at the Brownfields Property pursuant to paragraph 10.d.of the
Brownfields Agreement are continuing to fulfill their function.
