Sam Lockridge welcomed attendees. Attendees were asked to introduce themselves and were asked to sign the
attendance sheet
Marc Gilbert with Earnhardt Grading, Inc. was identified as Project Superintendent for this project. Daniel
Houser with Earnhardt Grading, Inc. was identified as Project Engineer.
Gary Head, Gene Wright and Sam Lockridge were identified as appropriate Solid Waste Staff to direct questions
or voice concerns to.
Wayne Sullivan is principle Engineer for the project and all changes will be directed to him.
/ Agenda topic: Pre‐Construction Requirements | Presenter Larry Frost
The State of North Carolina requires a pre‐construction meeting, this meeting will satisfy that requirement.
There are few construction permits required for this project, however; if any grubbing or burn permits are
needed, pictures should be sent to Larry Frost to assure that burn permits are being pulled.
404’s and 401’s should be obtained from the Corps of Engineers and DWR for any stream crossings that require
permits.
Provide a copy of the most recent Erosion/Sediment Control certificate to Larry Frost.
CQA should be submitted to Larry Frost as soon as possible once construction is complete. Mr. Frost will accept
the CQA in multiple pieces of subgrades and final. Mr. Frost is required by law to turn around the CQA within 30
days of receipt.

After project completion, the permit requires a pre‐operative meeting. Kim Su will conduct this meeting.
In one year, Cleveland County will provide a Financial Assurance to include the new Phase.

Contracts have been delivered to Cleveland County for execution along with bonds and certificate of insurance.
Executed contracts will be sent to the Engineer, then delivered to the contractor along with the notice to
proceed.
All applicable permits have been obtained with the exception of any necessary burning permits which much be
obtained by the Contractor.
Safety is the responsibility of the Contractor. The Contractor must be familiar with Sections 6.13 through 6.16
of the General Conditions regarding safety, hazard communications and emergencies. The requirements of the
noted Sections is mandatory per the Contract.
The Contractor will be notified immediately should unsafe conditions be observed by any Cleveland County
official, Municipal Engineering Services Company, PA Construction Observer or a County staff member.
The Contractor will assure that any unsafe condition reported is corrected immediately.
The project schedule will be forwarded to Municipal engineering within 10 days of the Notice to Proceed.
Municipal Engineering Services Company, PA will review the schedule and forward copies of the schedule to
the County and the State Regional Engineer for the Solid Waste Section.

The project schedule will be forwarded to Municipal Engineering Services Company, PA within 10 days of the
Notice to Proceed. Municipal Engineering Services Company, PA will review the schedule and forward copies to
the County and the State Regional Engineer for the Solid Waste Section.
Progress meetings will be held the second Thursday of each month at 11:00 am in the conference room at the
Self‐McNeilly Solid Waste Facility. The first meeting is scheduled for January 12, 2017 at 11:00 am.

The Schedule of Values on large lump sum bid items must be submitted along with the Project Schedule. The
Schedule of Values will be used to pay items of the lump sum items.
A list of sub‐contractors must be submitted with the construction schedule (within 10 days of the Notice to
Proceed).

Payment for stored materials will be made less 5% retainage on the monthly pay request. A receipt or bill of
sale for the items stored and a sales tax certification shall accompany the pay request.
The existing stockpile will be used for screening protective cover. The Contractor will notify and coordinate
with Cleveland County to assure Contractor does not hinder the ongoing daily operation of Cleveland County.
The Contractor will coordinate the area for material storage with Cleveland County to assure the County’s on‐
going daily operation is not hindered.
TIME IS OF THE ESSENCE. The contract allows for 210 days of construction time and an additional 45 days to
close the project (submit final pay request and other required closure documents).
The Contract contains a clause allowing an assessment of a sum of $1,000.00 per day as liquidated damages for
each calendar day the project construction is delayed beyond the scheduled completion date.

The Contract contains a clause allowing an assessment of a sum of $500.00 per day as liquidated damages for
each calendar day beyond the scheduled project closure.
Adjustment(s) to the time of completion will be allowed ONLY by a justifiable change order approved by the
Engineer and executed by the Owner. Article 12 of the General Conditions defines the method by which
changes in Contract time are processed. A log of weather conditions, days worked and a National Weather
Service listing of typical number of days of rain, based on a thirty year average, on a monthly basis is required
by Municipal Engineering Services Company, PA when considering changes due to unusual weather. Typically,
weather delay extensions are allowed only for those days over and above the usual number of days for the
subject month.
Typically, a “rain day” would not be claimed if work was performed for more than 3 hours during that day.

A change in the construction from the contract will not be permitted unless the change has been approved by
Municipal Engineering Services Company, PA, as stipulated by Article 10 of the General Conditions except in the
event of an emergency as described by paragraph 6.16. Changes in contract price shall be at the Contractor’s
expense without an executed Change Order prior to work completion.
Requests for Change Orders must include a complete breakdown, including a detailed calculation of cost with a
written explanation and justification for the requested change.
Change Orders submitted without the above stated information will not be considered and will be returned to
the Contractor for completion.

Preliminary Pay Applications must be submitted to the Municipal Engineering Services Company, PA on‐site
Construction Observer for approval of the quantities claimed for that period. Once this approval has been
received, Requests for Payment, along with a monthly certified sales tax report are to be submitted to
Municipal Engineering Services Company, PA’s Garner Office for final approval. Municipal Engineering Services
Company, PA will certify the request for payment as required by the General Conditions, Article 14, before
directing the request to the Owner for payment
Prior to the submittal of the Final Pay Request, the Contractor shall submit to Municipal Engineering Services
Company, PA, a Consent of Surety to the Contractor, Certificates of Inspections, Release and Waiver of Claims,
Warranties and Guarantees, Operating Manuals, and Affidavits certifying that all bills for labor and materials,
including subcontractors have been paid in full.
Pay Requests will be on document included in the contract documents of AIA Document G702 with the
continuation sheets containing the Schedule of Values and a Sales Tax Certification will accompany each pay
request.

The Contractor will notify Municipal Engineering Services Company, PA when the project is complete. Upon
receipt of notification, Municipal engineering Services Company, PA will perform an on‐site review of the
construction to verify completion.
A list of discrepancies (punch list) will be compiled during the review and given to the Contractor to make
adjustments/corrections.
A formal final review shall be coordinated and performed by Municipal Engineering Services Company, PA in
cooperation with the Contractor. and in the presence of the Owner upon correction of the discrepancies by the
Contractor.
Municipal Engineering Services Company, PA will coordinate and notify all parties of the time and date of the
formal final review.

A complete set of working drawings must be maintained at the construction site by the Contractor during the
construction process.
Any changes or deviations from the original drawings made in the construction by the Contractor shall be
shown on the drawings by the use of red colored pencils or pens.
The drawings will be submitted to the Engineer in order to prepare final “RECORD” Drawings.

All communication from the Contractor is to be directed to the Engineer
Any person found to possess firearms, alcoholic beverages, or drugs other than those prescribed to that
individual by a physician at the project site will be prosecuted by the law.
Individuals at the project site are expected to exhibit professional behavior at all times. Indecent or offensive
language, acts or attire will not be tolerated.
Restroom facilities will be provided by the Contractor.
Piezometers have been properly abandoned within the Phase 3 footprint and can be excavated along with
other excavation. Piezometers and monitoring wells outside of the Phase 3 footprint must not be damaged or
disturbed.
Water may be used from the on‐site hydrant with the proper metering; however, the Contractor has elected to
obtain water from the on‐site creek.
The cohesive soil will have a maximum permeability of 1.00 x 10‐5 cm/sec and is a minimum of 1.50 ft. thick
with a maximum thickness not to exceed 1.80 ft.
The protective cover is 3.00 ft. of screened on site material.
The leachate lines will be videoed after construction to assure there are no blockages of the lines.
A digital file of the sub grade with control points has been forwarded to the Contractor.
Changes requiring a Permit Modification must be submitted to and approved by the Solid Waste Section
Regional Engineer.
A Permit Modification will be submitted by the Engineer for the rain cover.
If removal of rock by blasting becomes necessary, a blasting plan must be submitted and approved by the Solid
Waste Section.
Weekly NPDES and self‐monitoring reports for construction and erosion control will be maintained by on‐site
personnel of Municipal Engineering Services Company, PA.
Survey data on the sub grade and top of cohesive soil must be available to the Engineer prior to constructing
the next component of the liner system.
Survey control points are points that have been used for various projects on the Landfill. They are included in
the data provided by the contractor in a CAD format
Survey data must be presented as points and each phase of construction must be taken at the same point.
Points on the 3:1 slopes, particularly the cohesive soil, must have an elevation difference of 1.58 feet to
represent 1.50 feet of cohesive soil.
On request, Municipal Engineering Services Company, PA will provide a sample of a past project.
