SCOTT Dh'<-'t This letter is written in response to your email dated 10/13/2016 to provide a contained-out determination for the contaminated groundwater removed from excavations at the Brownficlds construction site at 501 and 503 North Berkeley Blvd., Goldsboro, Wayne County, NC. For media contaminated with listed hazardous waste, contained-out determinations must be made on a case-by-case basis by EPA or a RCRA authorized state regulatory agency, based on the Contained-In Policy. The NC DEQ DWM Hazardous Waste Section is an authorized state regulatory agency. The two contaminants of concern in the groundwater in question are documented below approved Land Disposal Restriction risk-based standard concentrations levels. Tetrachloroethylene was documented in the groundwater at 5.4 ug!L and selenium was documented at 23 ug/L. Documentation has been submitted that the Goldsboro Water Reclamation Facility located at 714 Arrington Bridge Road, Goldsboro, has agreed to accept the groundwater for treatment and disposal under their NPDES permit. Therefore, the groundwater in question may be considered non-hazardous if managed through the Goldsboro publicly owned treatment works facility. Hi Lebeed,  After our discussion on Wednesday, I found where similar questions were posed to Julie by DSCA about a NC DOT  project back in 2014 on this same issue. Below is part of the HWS response, including some general contained out  options for groundwater contaminated with PCE or PCE and breakdown products.    The sole purpose of this response is to address issues of managing water that is (i) removed from the ground for  construction, maintenance, assessment or remediation and (ii) contains dry‐cleaning related PCE (or its breakdown  products) that is assumed to have originated from a listed waste.     Because this is considered a discarded commercial chemical product and is a listed waste (waste code U210), the  Hazardous Waste Program is unable to provide flexibility and the waste generated from dewatering operations must be  handled as follows.      1. All waters collected from wells, excavations, trenches, or drains for reasons related to construction, maintenance,  assessment or remediation, are to be containerized and tested. The samples should be analyzed for total concentrations  and reported down to the method detection limits.     2. Each container shall be tested for the suite(s) of compounds known or suspected to be present in the waters.     3. Based on the analytical results, waters shall be managed as follows:     a. Water must be managed as if it were hazardous waste if the levels are above 15A NCAC 2L standards:   i. PCE is equal to or greater than 0.7 ug/L;    ii. TCE is equal to or greater than 3 ug/L;    iii. VC is equal to or greater than 0.03 ug/L.     b. Water will have no management restrictions if all chemicals detected are below the lower of the applicable 15A NCAC  2B standards, 15A NCAC 2L standards, or the Federal Maximum Contaminant Levels (MCLs). In this case, the 2B and 2L  standards (above) are lower than the MCLs.  i. PCE is less than 0.7 ug/L;    ii. TCE is less than 2.5 ug/L;   iii. VC is less than 0.025 ug/L.    c. Alternately, develop site‐specific risk‐based standards for the project. The Hazardous Waste Section would be willing  to review such standards for approval. Water with contaminant concentrations below approved risk‐based standard  levels would be considered non‐hazardous waste but would require management through a publicly owned NPDES  wastewater treatment facility, with documented approval.    This looks like what we have here and I think we should be able to get some input from Sandy on site‐specific risk based Subject: Goldsboro Site Update and Need Your Help    Lebeed    The Goldsboro site is progressing well. However, we have run into an issue where two restaurant tenants recently  requested the installation of sub‐surface grease traps (two total). The installation of the grease traps encountered the  water table. All soils below the water table were placed into a total of four (4) roll‐off boxes and sampled under the  contained‐in policy as a precaution due to the known presence of a dry‐cleaning solvent groundwater plume from the  nearby Penny Cleaners DSCA site. The excavation had to be dewatered to complete the work and the water  (approximately 8,600‐gallons) was placed into a 20k gallon frac tank.  The sample results for the roll‐off boxes (ROB‐1  through ROB‐4, “A” and “B” designations for the two samples per box per the contained‐in policy) indicate that the soil  is non‐hazardous and plans are to ship it to a Subtitle D landfill. For the water in the frac tank, PCE showed up at a  concentration of 5.4 ug/L. Available information from DSCA assessment reports suggest that the PCE is likely from the  Penny Cleaners site. The other constituents detected in the water sample from the frac tank do not appear not to be  associated with the dry‐cleaning solvent release. The lab results are attached. Note the REP‐1 sample is a composite of  soil below the water table for additional analyses per the Subtitle D landfills requirements.    3 For the PCE in water, the concentration of 5.4 ug/L is well below below the LDR of 0.056 mg/L (or 56.0 ug/L) – see  below. Can this water be classified as non‐hazardous based on the use of the PCE LDR? Additionally, there is uncertainty  if the detection is from virgin or spent solvent.     This issue came up quickly and the site design/construction processes purposely avoided encountering groundwater up  until this point. Your help and approval on how to manage this waste would certainly be appreciated as the cost to  dispose of this much water as hazardous is very expensive (+ $40,000).
