The Permit to Operate expired on November 10, 2015. A permit renewal application was submitted to the Solid Waste Section and is currently under review. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. The facility consists of a Construction and Demolition Landfill located on top of a Closed, unlined MSW Landfill. 2. The facility is permitted to receive solid waste generated within Alexander County. 3. The facility had proper signage.  Lettering showing the operating hours of the facility were beginning to peel and are in need of repair. Please ensure that steps are taken to ensure that the operating hours of the facility remain clearly visible. Records Review: 4. The Permit to Operate and Operations Plan were verified. Both documents were current and available upon request. As noted above, a permit renewal application has been received by the Solid Waste Section and is currently under review. 5. Waste tonnage reports were verified for July 2014 through March 2016. The facility accepted 4560.62 tons of waste during this time period. 6. Water Quality Monitoring Reports were observed. First semi-annual monitoring results for 2015 (performed June 16-18, 2015) and first semi-annual monitoring results for 2016 (performed January 5-7, 2016 were verified.  Semiannual monitoring was conducted. However, the second monitoring event was delayed until the first week of January 2016. 7. Methane monitoring was being performed quarterly as required. Monitoring reports for events performed on 3/16/15, 6/18/15, 9/26/15, and 12/16/15 were verified. No exceedances above applicable standards were observed at the property boundaries. 8. Waste screening reports from May 17, 2015 through April 21, 2016 were verified. Reports were performed with good frequency and appeared to represent 1% of the waste stream. 9. Soil cover records were observed. It appeared that cover was being applied weekly. It was discussed with Mr. Mitchell that during cover activities, all waste within the landfill must covered with six inches of earthen material. 10. Story (expires 2/13/18) Operations Inspection of the C&DLF Unit: 11. The working face was less than one-half acre in size at the time of inspection. 12. Waste was being placed on the north side of the landfill. 13. No unacceptable waste streams were observed. 14. A small amount of windblown waste was observed on the east and south sides of the landfill during the inspection. However, the windblown waste was deposited near the working face and had not traveled beyond the footprint of the landfill. Please ensure that all windblown is picked up and returned to the working face by the end of each working day.  Facility staff had installed a new wind fence along the eastern perimeter of the landfill since the last inspection to aid in control of windblown litter. 15. Inactive portions of the landfill were found to have good, operational cover. 16. Mr. Mitchell explained that the portion of the north slope adjacent to the working face to the east had recently been seeded. 17. Efforts need to continue to stabilize inactive slopes located on the west and south sides of the landfill. Mr. Mitchell explained that slopes had been reseeded since the last inspection, but many areas of thin to bare vegetation were observed. 18. All access roads were of all-weather construction and well maintained. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 3 19. A landfill collection control system consisting of three landfill gas extraction wells (MEW-1, MEW-2, and MEW- 3) and a blower system is located along the north side of the closed MSWLF and has been in operation since November 2012. However, this system does not appear to be consistent with the active methane gas system originally approved as part of the Corrective Action Plan (CAP) and subsequent addendums which included the installation of 10 landfill gas extraction wells and a flare.
