ADDITIONAL COMMENTS
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
OBSERVED VIOLATIONS:
-All photos were taken by Lee Hill on May 11,2016
-The facility is secured by gate and chain-link fence that surrounds the facility.
-The facility is not open to the public and only accepts material from that is picked up by the City of Brevard.
-Minimal unacceptable material was observed in recently dumped loads.Please continue to remove any unacceptable material and dispose of it
properly.
-Standing water was observed on the northwest side of the unground material.Positive drainage must be maintained to prevent standing water from
occurring.**Please see observed violations section of this report.**
-The unground material stockpile consisted of yard trash and land clearing debris.
-Cantrell Construction of Brevard grinds the material on an as needed basis.
-Temperatures of the finished material are taken on a monthly basis and records from July 2015 to present were available for review.
-The current stockpile of finished material had temperatures readings of 131F on February 1,2016,134F on February 2,2016 and 135F on February
3,2016.
-The access road to the facility was gravel and was in good condition.
-No objectionable odors were observed at the time of inspection.
15A NCAC 13B .1406(3)states:"Surface water shall be diverted from the operational,compost curing,and storage areas."
The City of Brevard is in violation of 15A NCAC 13B .1406(3)by failing to divert surface water from the storage area.Ponding water was observed in
the unground material storage area.
The City of Brevard must immediately divert surface water and grade the area to ensure positive drainage so that water will not be impounded.
