Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. OBSERVED VIOLATIONS: -All photos were taken by Lee Hill on May 5,2016. -The facility is owned,operated and managed by Macon County. -J&B Disposal Inc.hauls material from the facility to the Macon County Landfill in Franklin,NC. -The facility service area is Macon County. -The facility hours of operations Monday through Friday 7:30am to 4:30pm and Saturday 8:00am to 2:00pm. -The facility sign states the permit number as 57-047,the correct permit number is 5704T.Please update the sign to reflect the proper permit number. Records review -The permit and current operations plan were available upon request. -Tonnage records for April through present were reviewed.The facility receives approximately 30 tons per day Monday through Friday and 1.5 tons on Saturday. -Waste screening forms were available and reviewed from 1/4/2016 to present.The facility conducts one to two waste screenings per week.The forms appeared to be filled out correctly and showed final disposition of any unacceptable waste that was observed. -Certified Transfer Station Operators -Ethan B.Garrett (expires September 13,2016) -Tracy Sellino (expires August 14,2018) -Tommy Keener (expires March 12,2019) -The leachate collection system is connected to two 2500 gallon holding tanks.Pumping records were available for review.2500 gallons of leachate was pumped from the tanks on 4/5/2016,1/29/2016,and12/2/2015. -Scrap tires from 1/4/2016 to 5/4/2016 were reviewed and appeared to be filled out correctly. Operations Inspection of Transfer Station (5704T) -The facility consists of a pre-engineered steel building with a single loading bay. -The tipping floor and push walls were observed and appeared to be in good condition. -Residential and commercial customers dump their waste directly onto the tipping floor. 15A NCAC 13B .0203(d)states in part:“by receiving solid waste at a permitted facility,the permittee(s)shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.”Permit to Operate No.5704,Attachment 3,Condition of Permit to Operate, Part VI,#8(b)states in part that:“Waste must only be deposited on a “tipping floor”or directly into a transfer container.” Macon County is in violation of 15A NCAC 13B .0203(d)by failing to deposit all waste onto the tipping floor.Mattresses were observed deposited and stored outside on the west side of the transfer building. Macon County must immediately remove all material from the outside of the transfer building and return it to the tipping floor or transfer container. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Sent on: Email Hand delivery US Mail Certified No. [ _] Copies: ______________________________________________ Signature ADDITIONAL COMMENTS -**Mattresses were observed outside of the transfer building.All waste must be deposited on the tipping floor or deposited directly into a transfer container.Please see observed violation section of this report.** -No unacceptable material was observed on the tipping floor at the time of inspection. -Trench drains were clear and appeared to be working properly. -Minimal windblown material was observed at the time of inspection.Facility staff were actively policing the grounds for windblown litter at the time of inspection. -Loaded trailers are parked on concrete pads with trench drains connected to the leachate collection system. -Pallets are collected to the southwest of the transfer station. Operations inspection of Grinding Area. -Land clearing material,brush and leaves are collected to the south west of the scale house. -The facility is permitted to receive yard trash as defined in 15A NCAC 13B.0101(55).However,this ground material containing yard trash may not be distributed to the public unless it has been composted in accordance with 15A NCAC 13B.1400. -The ground material is used onsite for erosion control and to aid in establishing a hummic layer to help in the establishment of grass on slopes and other areas that are primarily saprolite. -The ground material is also taken to the Macon County Landfill and mixed with soil for Approved Alternate Daily Cover. -No ground material is distributed to the public. -No unacceptable material was observed during the inspection.Please continue to remove any unacceptable material and dispose of it properly. Operations Inspection of White Goods,Tire,Used Oil,Convenience,Electronics and Recycling Area. -White goods collected at the facility are transported to the Macon County Landfill for refrigerant extraction and recycling. -White goods containing refrigerants were observed stored upright. -Tires are collected in van trailers and transported to the Macon County Landfill.The tires are then taken to Northeast Georgia Tire Recycling for disposal. -Used oil and cooking oil is collected at the site.The used oil collection is under cover and has secondary containment. -Number one and two plastics and aluminum cans are collected and transported to the Macon County Landfill facility for processing. -Electronics are collected in a roll off container and are transported to the Macon County Landfill for sorting and palletizing. -The transfer building is closed on Saturdays and material is deposited in 40 yard roll off containers located to the north of the scalehouse.
