Dear Mr. Howard:
On April 22, 2016 the Division Waste Management (DWM), Solid Waste Section (SWS)
received an electronic copy of a written request (DIN 26023), prepared by CDM Smith, Inc. on
behalf of Cumberland County (the County), to modify the interim closure grades of the above-
referenced lined MSWLF Unit - Phase III in order to increase the operating air space of the
Phase III, which is a vertical expansion over the existing MSWLF - Phases I and II. After
reviewing the permit modification application, the SWS approves the County’s request to
increase:
Interim closure grades of the lined MSWLF Unit - Phase III from 205 to 215 feet above
of mean seal level as shown on the Figures 1-1 and 1-2 (DIN 26023).
The eastern side of slope of the lined MSWLF at a slope of 3.5 (horizontal) to 1
(vertical).
The operating capacity of Phase III. The approved gross capacity of the existing Phases I,
II, and III is 4,157,653 cubic yards (CY). The approved total gross capacity of the lined
MSWLF is 6,682,400 CY, which is not changed.
Although, the current Permit to Operate (DIN16753) for the MSWLF – Phases I, II, & III
expired on February 12, 2016, the SWS acknowledges that the County submitted a complete
permit application (DIN 24880 and DIN26012) in a timely manner. Therefore, the county may
continue to operate under the terms and conditions of the existing permit until a decision on the
application is made by the SWS. The County should continue to operate the lined MSWLF –
Phases I, II, & III under the conditions of the existing Permit to Operate (DIN 16753) and the
additional conditions stated in this letter.
Additionally, the SWS is currently reviewing the Permit to Construct (PTC) Application for the
lined MSWLF – Phase IV, which was originally submitted on August 18, 2015 (DIN 24880) and
revised on March 28, 2016 and received by the SWS on April 29, 2016 (DIN26012). If the PTC

Application meets all the requirements stated in the rules and statutes, a Life-Of-Site Permit
according to the North Carolina Session Law 2015-241 will be issued to the County on or after
July 1, 2016, which is earliest effect date of the Life-Of-Site Permit of a sanitary landfill or a
transfer station.
