If you recall, a few months ago we submitted a Design Hydrogeo Report for Phase 5 of the Robeson County 
Landfill (Permit # 78‐03), which you approved in a letter dated August 12, 2015.  In September 2015, we met 
with you and Ed Mussler concerning the plans for the landfill expansion (see below), and we sent you updated 
drawings because the proposed Phase 5 footprint was changed to add an additional 1.6 acres, extending the 
footprint westward to the buffer line.   

Similarly, we would now like to further expand the footprint of Phase 5 northward to the existing property 
boundary, since that will be the buffer line after the additional recently‐purchased property is added to the 
facility.  This will add an additional 2.4 acres to bring the total footprint for Phase 5 to 19 acres.  Attached are a 
new set of revised drawings  for the Design Hydrogeo Report which show the new footprint.   

We are currently preparing a Permit to Construct for Phase 5 in which we will design the entire 19 acre 
footprint; however, as we discussed when we met with you and Ed Mussler, we will structure the PTC 
application to only permit the area within the current 300‐foot buffer until such time as a major permit 
amendment is approved to add the additional acreage to the north.  This means that the additional 2.4 acres 
we are proposing to add to Phase 5 will not be permitted in this PTC application.   Please let us know if this 
new footprint for Phase 5 is acceptable, and advise us if you need any additional information.  Thank you.

I just want to confirm what we discussed at our meeting with you and Ed Mussler on September 4th
concerning the Addendum to our Design Hydrogeologic Report and the plans to submit a Permit to
Construct (PTC) Application Phase 5 of the Robeson County Landfill (Permit # 78-03).

We discussed the fact that we increased the footprint of Phase 5 to 16.6 acres by moving the western
edge of Phase 5 to correspond with the current 300-foot buffer. My understanding from the meeting
was that this change would not require any additional hydrogeologic investigation, and that all you
needed was the addendum we had sent you (attached).

The second thing we discussed was that in order to permit the portion of Phase 5 that requires the
additional property to the northwest for buffer, we would have to go through a major permit
amendment. We agreed on a plan to design the entire Phase 5 cell, but to structure the PTC
application to only permit the area within the current 300-foot buffer until such time at the additional
property is purchased and the major permit amendment is approved.

Can you please confirm that the above statements are correct. Thank you.
