ADDITIONAL COMMENTS
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
OBSERVED VIOLATIONS:
On May 9,2016,John Patrone met with Ken Van Derveer and Andy Roberts to conduct a comprehensive inspection of the Stokesdale LCID,Inc.
Landfill on Pearman Quarry Road in Stokesdale,Guilford County.
1.The Stokesdale LCID,Inc.Landfill is a notified land clearing and inert debris (LCID)landfill.
2.The LCID landfill is ~1/2 acre.
3.The LCID landfill is open to the general public and also used by Tri-City Trucking,Inc.
4.Mr.Roberts removes logs from land clearing debris (LCD)and stores them separately for milling.
5.Per 15A NCAC 13B .0566(3),“Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.”
6.Per 15A NCAC 13B .0566(4),“Adequate soil cover shall be applied monthly,or when the active area reaches one acre in size,whichever occurs
first.”
7.Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed.
8.Ensure a ready supply of soil is available on site for cover material.
9.Open burning of solid waste is prohibited.
10.There was no indication of erosion or runoff.
11.The facility has an all-weather access road.
12.The facility is secured by a locked gate.
13.The facility has a proper sign.It is suggested that the facility identification number is also posted:N1082.
14.The SWS will conduct a follow-up inspection by June 9,2016 to observe that LCD has been adequately covered with soil.
15.A copy of the land clearing and inert debris landfill notification submitted to the SWS and a copy of the pertinent LCID landfill rules was given
to Mr.Van Derveer.
16.Mr.Van Derveer was also given a LCID landfill notification application in order to update:address,deed book and page numbers,and
property owners.
