STATUS OF PERMIT: Active Issued: 1/17/2016 Expires: 12/31/2016 PURPOSE OF SITE VISIT: New Pumper Vehicle Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 15A NCAC 13B .0844 (b) states: “All permitted septage management firms shall display decals or lettering on each side of every pumper vehicle operated by the firm. The decals or lettering shall include the name, address (town name), phone number, and septage management firm permit number. All decals or lettering on the pumper vehicle shall be no less than three inches in height and plainly visible. Identification shall be permanently attached (i.e., no removable signs).” On May 4, 2016, Overbey’s Septic Tank Service, Inc. was in violation of 15A NCAC 13B .0844 (b) because the permit number, city name, and a portion of the name were measured to be under 3 inches in height. In order to come into compliance, by May 20, 2016, Overbey’s Septic Tank Service, Inc. must correct the required lettering to no less than 3” in height. As discussed on 5/5/2016 via telephone, an option would be to resubmit the “Application to Operate a Septage Management Firm” (application) and only put “Overbey’s” as the firm name. For the city name and permit number, you have the option to correct lettering on the pumper vehicle or place additional lettering elsewhere on both sides of the vehicle to at least 3” or larger. The application must be submitted to the address on the form. The following vehicle was observed at the North Carolina DOT Rest Area located just off the West Bound Lane of I-40 in McDowell County. The permit number, city name, and a portion of the name were measured to be under 3 inches in height. Photo taken by Troy Harrison 3. The tank appeared to be structurally sound, constructed of approved materials and permanently attached to the vehicles. 4. The valves and access ports appeared to be in working order with caps on all access ports. 5. No leaks were observed. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
