PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None ADDITIONAL COMMENTS 1. The facility is a Land Clearing and Inert Debris Landfill Notification site which is permitted to accept only land clearing waste, inert debris, untreated wood and yard trash. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 2. Ensure all land clearing waste generated from the construction of the Shane E. Hildebrand Family Subdivision is pushed into the landfill and adequate soil cover applied monthly, or when the active area reaches one acre in size, whichever occurs first, as required by 15A NCAC 13B .0566(4). All waste accepted from other locations is being deposited in the landfill. Mr. Hildebrand stated all waste generated from the development of the family subdivision will be pushed into the landfill and covered properly after the current rain event. 3. The facility appears to be accepting waste that it is allowed to receive. 4. No surface water was observed ponded around waste. 5. Ensure the facility is adequately secured by means of gates, chains, berms, fences, etc. to prevent unauthorized access except when an operator is on duty. An attendant shall be on duty at all times while the landfill is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes, as required by 15A NCAC 13B .0566(8). According to Mr. Hildebrand, the gate is under construction. 6. Access roads are of all-weather construction and in good condition. 7. Ensure that a sign is posted at the facility entrance showing the contact name and number and the permit number, as required by 15A NCAC 13B .0566(16). Ensure permanent edge of waste markers that accurately designate the waste disposal boundary are installed and maintained at the facility. 9.
