Box 19669 Raleigh, North Carolina 27619 PARTICIPANTS: Shawn McKee, NCDEQ, Solid Waste Elizabeth Werner, NCDEQ, Solid Waste STATUS OF PERMIT: Coal Combustion Products Structural Fill constructed per 15A NCAC 13B .1700 Solid Waste Rules PURPOSE OF SITE VISIT: Comprehensive inspection to ensure that the Structural Fill Facility is in compliance with 15A North Carolina Administration Code (NCAC) 13B. 1700, “Requirements For Beneficial Use Of Coal Combustion By-Products.” STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The “Family Dollar” structural fill project was completed in 2006 located in Weldon, NC near the intersection of 3rd Street and Highway 301. According to the Halifax County Tax Assessor, the structural fill is located on 2 parcels identified as 1202019 (western parcel owned by HP Weldon FDLLC) and 1200321 (eastern parcel owned by Eastern Pride, Inc.). The Family Dollar, which is located on the western parcel, is addressed as 210 E 2nd St, Weldon, NC 27890. 2. Approximately 12,080 tons of coal combustion products were utilized in the construction of the structural fill. The structural fill operation was performed by Plumbline Corporation. The coal combustion products were generated by the Roanoke Valley Energy facility in Weldon, NC. Ash was placed within the 40-foot drainage easement adjacent to 3rd Street. 3. Approximately half of the properties on which the structural fill is located is currently being used for retail and associated asphalt covered parking. The developed portion consists of a building, asphalt paved parking areas and areas of landscaping. The undeveloped portion is vegetated but an unpaved area is subject to vehicle traffic which has the possibility to compromise the cover and expose the underlying ash. 4. The structural fill shall be covered with a minimum of 12-inches compacted earth and an additional 6-inches of surface soil capable of supporting native vegetation as per 15A NCAC 13B .1705(j). The coal ash structural fill spans both the parcels in red. A Family Dollar store is located on the parcel on the left. The site was recorded by the Ronald Keeter, NCDOT, with the Halifax County Register of Deeds on August 11, 2010. The recordation can be found in Book 2321, Page 166. Area receiving vehicular traffic in foreground. Eastern side of Family Dollar store. 6. Part of the structural fill adjacent to the paved area is subject to vehicular traffic. Although gravel appears to have been placed in this area previously, rutting of the soil cover is beginning to occur. Coal ash was not observed at the time of the inspection, however measures to limit the impacts of vehicles are strongly advised. It is strongly recommended that the property owners coordinate to either limit vehicular access or reinforce the area with additional gravel or pavement.
