Dear Mr. Nicholson:
On behalf of Enfield Timber, LLC, please find attached the brownfields application for the site referenced
above. We have contracted to purchase the property from Old QFP, lnc. once we have received eligibility
from the North Carolina Brownfields Program. Enfield Timber plans to redevelop this former wood-
treatment facility that has been abandoned since 2009. We will initially utilize the property for a sawmill
to cut hardwood timber for rai lroad ties, logging mats and crane mats. The logg ing mats and crane mats
will be assembled on the property. Eventually the property will also be used to treat railroad ties with
creosote and boron using new state-of-the-art eq uipment. Creosote was not used at the site previously in
the hi storical wood treatment processes.
Enfield Timber believes this redevelopment project has significant public benefits for Halifax County, a
Tier I county with high poverty and unemployment rates. We estimate Enfield Timber will add 20 new
permanent jobs, with an additional I 0 temporary construction jobs during the site redevelopment. With
Enfield 's population of about I ,800, these jobs can make a difference to the local economy. The
redevelopment project will also revitalize an area that has been vacant for several years.

Explanation Per agreement with the North Carolina Hazardous Waste Section, the seller of
the property, Old QFP, Inc. is paying for the costs associated with the brownfields agreement
for the PD. The PD has the financial ability to redevelop the property, which they estimate
will be around $3,000,000.

Explanation George M. Junkin has the managerial means to fully implement a brownfields
agreement and assure the safe reuse of the property. Mr. Junkin is president of American
Land Concepts, Inc. (ALC). ALC is an environmental company specializing in environmental
services to landowners, developers, and industry. ALC has experience with brownfields sites
and with the oversight of underground storage tank closures and remediation.
F. Does PD have or can it obtain the technical means to fully implement a brownfields
agreement and assure the safe use of the property?

Explanation Enfield Timber, LLC, through Old QFP Inc., will use Daphne Jones of
Duncklee & Dunham, P.C. to oversee the technical aspects of the brownfields agreement
project. Ms. Jones has nearly ten years of experience in dealing with North Carolina
Brownfields Program requirements, both as an NCBP project manager and a consultant for
Duncklee & Dunham. Mr. Sean Sullivan, environmental attorney with Williams Mullen, is
experienced with the legal aspects of the brownfields agreement process and will be the
point of contact between the PD and the North Carolina Brownfields Program (NCBP).

B. Regulatory Agency Involvement: List the site names and all identifying numbers (ID No.)
previously or currently assigned by any federal, state or local environmental regulatory
agencies for the property. The ID No’s may include CERCLIS numbers, RCRA generator
numbers for past and present operations, UST database, Division of Water Quality’s incident
management database, and/or Inactive Hazardous Sites Branch inventory numbers. (In
many instances, the PD will need to actively seek out this information by reading
environmental site assessment reports, reviewing government files, contacting government
officials, and through the use of government databases, many of which may be available over

Agency Name/ID No: NONCD0002350 - Old QFP Inc. entered the site into the voluntary
Registered Environmental Consultant Program through the North Carolina Inactive
Hazardous Sites Branch in 2009. Remedial action through excavation of contaminated soil
to risk-based levels was completed in 2011, with continued groundwater monitoring.
Agency Name/ID No: NCD 084 173 830 - RCRA-regulated wood-treatment drip pads. Since
Old QFP, Inc. is no longer in busisness, there were not enough funds remaining to
remediate/stabilize the soil under the RCRA drip pads or enter into a RCRA post-closure
permit. An agreement was made between Old QFP and the NC Hazardous Waste Section
that administers the RCRA program. This agreement will allow Old QFP to sell the property
to Enfield Timber LLC and utilize its remaining funds to pay for the work associated with the
PD obtaining a brownfields agreement.

C. In what way(s) is the property is abandoned, idled, or underused?
The property was operated by Quality Forest Products, Inc., which is now known as Old QFP
Inc., from 1977 until August 2006. Fortress Wood Products took over operations in August
2006, ending in November 2008, and then re-opened operations temporarily during the
month of May 2009. The property has been idle and abandoned since June 2009.
D. In what way(s) is the actual or possible contamination at the property a hindrance to
development or redevelopment of the property (attach any supporting documentation such as
letters from lending institutions)?
Although the site has been remediated to industrial risk-based levels under the Registered
Environmental Consultant program, there is the possibility that a future REC audit or change(s)
in toxicological studies that would affect clean-up levels could re-open the project. Also, there is
no liability protection offered by the REC program to the remediating parties or future owners of
the site, such as that given by the DENR covenant-not-to-sue offered under a BFA.
The PD needs to ensure it will not be responsible for the remediation of any contamination due
to past industrial practices at the site. The two former treated-wood drip pads at the southern
end of the property are currently regulated under RCRA, and the PD wants to ensure the RCRA
liability will not be transferred with the ownership of the property. The Hazardous Waste Section
has agreed that redevelopment of the property is important, and they will allow the oversight of
the drip pads to pass to the Superfund Section's Inactive Hazardous Sites Branch when the PD
purchases the property and obtains a brownfields agreement. The PD has determined that the
North Carolina Brownfields Program is its best option for liability protection.
E. In what way(s) is the redevelopment of the property difficult or impossible without a
brownfields agreement (attach any supporting documentation such as letters form lending
institutions)?
Based on the past history and known contamination at the site, Enfield Timber cannot
purchase and redevelop this property without the assurance that they will not be held
responsible for prior contamination at the site.
F. What are the planned use(s) of the redeveloped brownfields property to which the PD will
commit? Be as specific as specific as possible.
Initially, Enfield Timber, LLC, will utilize the property as a sawmill to cut hardwood timber for
railroad ties, logging mats, and crane mats. The property will also be utilized for the
assembly of the logging and crane mats. Once capped, the drip pads will be used to store
the logging and crane mats. Eventually the property may be used to treat railroad ties. If this
occurs, Enfield Timber, LLC will construct a new state of the art facility to treat the railroad
ties with creosote and boron.
G. Current tax value of brownfields property: $795,590 (land and buildings). See 2012 Halifax
County Assessment Information and Halifax County GIS parcel map in Appendix B.
H. Estimated capital investment in redevelopment project: $3,000,000

I. List and describe the public benefits that will result from the property’s redevelopment. Be as
specific as possible. (Examples of public benefits for brownfields projects include job creation,
tax base increases, revitalization of blighted areas, preserved green space, preserved historic
places, improving disadvantaged neighborhood quality-of-life related retail shopping
opportunities, affordable housing, environmental cleanup activities or set asides that have
community or environmental benefits. In gauging public benefit, NCBP places great value
upon letters of support from community groups and local government that describe
anticipated improvements in quality of life for neighboring communities that the project will
bring about. The inclusion of such support letters with this application is recommended and
encouraged.)
This property is rural, approximately 2 miles from the center of Enfield, population 1,791 in
2010. Halifax County has Tier 1 status (most impoverished), with a 34% poverty rate in 2010
compared to the 14% rate for North Carolina.
The reopening of site for a sawmill and assembly of logging and crane mats, and eventually
creosote wood treatment operations will bring approximately 20 new jobs to the area, which is
significant. Additionally, there will be approximately 10 temporary construction jobs associated
with this redevelopment project. The revitalization of decaying facilties will also increase the tax
base, another benefit to this this Tier 1 county.
Special Note: Please describe all environment-friendly technologies and designs PD plans
to utilize in its redevelopment strategy. For example, environment friendly redevelopment
plans could include: Leadership in Energy and Environmental Design (LEED) Certification,
green building materials; green landscaping techniques such as using drought resistant
plants; energy efficient designs, materials, appliances, machinery, etc.; renewable sources of
energy, and/or recycling/reuse of old building materials such as brick or wood.
Enfield Timber plans to reuse buildings 5, 6, 12, and 13. Buildings 7, 9, and 18 will likely be
demolished. The final status of the remaining buildings are uncertain at this time. Enfield
Timber LLC., plans to recycle building materials from demolished buildings on the
redevelopment project. Building locations are noted on a site map included as Appendix C.

A. Brownfields Affidavit: PD must provide its certification, in the form of a signed and
notarized original of the unmodified model brownfields affidavit provided by NCBP, that it
did not cause or contribute to contamination at the property and that it meets all other
statutory eligibility requirements. (Note: The form to use for this affidavit is attached to this
application. It must be filled out signed notarized, and submitted with this application.)

Appendix D.

above link, or often through retail outdoor recreation stores that can print out the relevant
map. Often environmental reports have location maps that use this type of map as the base
for its location map.)

D. Survey Plat: PD must provide a preliminary survey plat of the brownfields property with the
property boundaries clearly identified, and a metes and bounds legal description that
matches the property description on the plat. At this stage of the brownfields process; one
or more existing survey plats from a previous property conveyance will suffice. (Before the
brownfields project enters the public comment phase of the brownfields process, the PD will
be required to submit a final brownfields survey plat which includes the information listed in
the brownfields survey plat guidance.)

Answer There is a 1982 survey plat attached as Appendix G. The 1977 deed that has
the legal description at that time is also included. The PD will obtain a new survey plat,
including the additional information required for the brownfields program along with a current
legal description, prior to the completion of the brownfields process.
E. Site Photographs: PD must provide at least one pre-redevelopment photograph of the
property, in either hard copy or electronic format that shows existing facilities and
structures. Please note that the NCBP prefers to have electronic photos instead of or
in addition to hard copies. Electronic copies of photographs should be emailed to:

Preliminary Proposed Brownfields Agreement
I. Property Facts
a. Property Address(es): 21144 US Hwy 301 South, Enfield, North Carolina
b. Property Seller: Old QFP Inc.
c. Property Buyer: Enfield Timber, LLC
d. Brief Property Usage History: The property had a Georgia-Pacific sawmill that operated until
it was destroyed in a fire around 1975. QFP operated a treated-wood products facility using
chromated copper arsenate (CCA) from 1977-2002. Beginning in 1985, QFP used two other
treatment chemicals known as Alkaline Copper Quaternery (ACQ) and D-Blaze, a proprietary
solution of inorganic compounds containing a phospho-ammonia boron complex used as a fire
retardant. When the production of CCA-treated wood ended in 2002, QFP continued to use
ACQ and D-Blaze until 2006. In 2006, QFP leased the facility to Fortress Wood Products, that
continued ACQ and D-Blaze operations until May 2009. The property has been vacant since that
time.

III. Protective Measures
I am prepared to take steps necessary to make the property suitable for its planned uses while
fully protecting public health and the environment. I propose that NCBP consider a brownfields
agreement that will make the property suitable for the planned use(s) through the following
mechanism(s) (check all that apply):
Contaminant remediation to risk-based levels.
Engineered Controls (e.g., low permeability caps, vapor mitigation systems, etc)
Land use restrictions that run with the land that will restrict or prohibit uses that are
unacceptable from a risk assessment/management perspective. (Important Note: In any
.final brownfields agreement generated by the NC'BP. land use restrictions will ultimately
come with the continuing obligation to submit an annual cert~fication that the Land Use
Resfl ·ictions are being complied with and are recorded at the applicable register of deeds
office.)
IV. Fees
In connection with a brownfields agreement, the Act requires that the developer pay fees to
offset the cost to the State. In satisfaction of the Act, the following fees apply to any brownfields
agreement that is developed for this project:
a. A $2,000 initial fee will be due from the applicant PD when both of the following occur:
I) NCBP receives this application and proposed brownfields agreement, AND
2) NCBP notifies the applicant in writing that the applicant PD and the project are eligible for
participation in the NCBP and continued negotiation of a brownfields agreement.
b. A second fee of $3,500.00 will be due from the PD prior to execution of brownfields
agreement.
c. Any addendum/modifications to the BFA or NBP after they are in effect wi II result in an
additional fee of at least $1 ,000.00.
d. In the unexpected event that the environmental conditions at the property are unusually
complex, such that NCBP's costs will clearly exceed the above amounts, NCBP and PD will
negotiate additional fees.
