Dear Mr. Plessinger:

The permit to construct application for Phase 2B (DIN 25398 and 25399) proposed an alternative cap
system for closure of the landfill. The Division of Waste Management, Solid Waste Section (Section), has
reviewed the modified closure plan and has determined that it meets the requirements for an
alternative cap system as stated in 15A NCAC 13B .0543(e)(3). Therefore, per this letter, the Section
approves the modification of the closure plan.

Please submit your construction quality assurance report for the partial closure of Phase 1 as soon as
possible so it can be included in the current permit action.
