(SR-1151) Shelby, NC 28152 GPS COORDINATES: N: 35.27318° W: 81.59380° FACILITY CONTACT NAME AND PHONE NUMBER: Name: Kati Beaver Telephone: (704) 487-9997 Email address: wessonseptictanks@gmail.com FACILITY CONTACT ADDRESS: Same as above PARTICIPANTS: Troy Harrison, Solid Waste Section Kati Beaver, Wesson Septic Tank Service STATUS OF PERMIT: Active Permit issued: December 31, 2014 Expires: October 18, 2019 PURPOSE OF SITE VISIT: Inspection STATUS OF PAST NOTED VIOLATIONS: 15A North Carolina Administrative Code (NCAC) 13B .0841(g) states: Each detention and treatment facility shall be designed, constructed, and maintained in such a manner as to: (1) Prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters; On October 15, 2015, Wesson Septic Tank Services, Inc. (the company) was in violation of 15A NCAC 13B .0841(g) because the 10,000 Septage Detention Tank as described in Solid Waste Permit SDTF-23-10 (tank) was observed leaking waste onto the ground. In order to correct the violation, in a Notice of Deficiency (NOD) dated October 29, 2015, the company was required to: 1. Immediately remove all waste from the tank and dispose at a properly permitted facility and discontinue use; 2. Immediately clean up all waste material on the ground that resulted from the leak; FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 3. Treat the area of the leak with hydrated lime; and 4. Provide a written certification with supporting documentation on company letterhead confirming the corrective actions have been completed. Include in this certification any actions taken to prevent these deficiencies from occurring in the future by November 13, 2015. On October 29, 2019, a response was received from the company stating that the required steps had been taken. On February 15, 2016, it was observed that the tank had been emptied and taken out of service. The violation of 15A North Carolina Administrative Code (NCAC) 13B .0841(g) as described in the NOD is resolved. OBSERVED VIOLATIONS: N/A ADDITIONAL COMMENTS 1. All photographs were taken by Troy Harrison on February 25, 2016. 2. The facility consists of one steel, 10,000 gallon, above ground tank that has been drained and removed from service due to rust and leaks. The leaks were observed in the previous inspection on October 15, 2015 in which the tank was observed to have an active seeping leak on the side with a small amount of septage on the ground. 3. There is another tank on site that is empty and not being used, according to the company. This tank is going replace the old one, according to the company. This tank cannot be used until added to the permit. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
