This dilution shall be increased if crop damage occurs. This dilution requirement shall not apply to the liquid portion of grease septage that has been adequately treated to remove solids, fats, oils and grease as long as crop damage does not occur;” Wesson Septic Tank Service (the company) was in violation of 15A NCAC 13B .0838(a)(15) because there was an area where, based on visual evidence, a septage application had not been sufficiently treated and diluted; resulting in crop damage in Field 1. In order to come into compliance, the company must implement changes to land application methods to prevent field damage and repair/reseed the damaged areas to maintain the fescue crop stand. All photographs were taken by Troy Harrison on February 25, 2016. 2. The Septage Land Application Site consists of Field 1 (8 acres) and Field 2 (8 acres). 3. The site is permitted for land application of domestic septage and grease septage. 4. The site is located at 707 Poplar Springs Church Road and has accessible all-weather roads to the septage land application field covered under the permit. 5. Appropriate signage was displayed at the site. 6. Disposal area boundaries were delineated with permanent markers. 7. All septage discharges appear to have been made within the disposal area boundary. 8. There is no evidence of standing liquid or pooled waste. There was an area where, based on visual evidence, a septage application had not been sufficiently treated and diluted; resulting in crop damage in Field 1. 9. No objectionable odors were observed. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
