Box 948 Bryson City, NC 28713 PARTICIPANTS: Troy Harrison, NC Solid Waste Section Lee Hill, NC Solid Waste Section STATUS OF PERMIT: Active Issued: July 17, 2012 Expires: July 17, 2017 PURPOSE OF SITE VISIT: Routine Inspection STATUS OF PAST NOTED VIOLATIONS: (1) North Carolina General Statute 130A-291.1(d) states: “Septage shall be treated and disposed only at a wastewater system that has been approved by the Department under rules adopted by the Commission or by the Environmental Management Commission or at a site that is permitted by the Department under this section. A permit shall be issued only if the site satisfies all of the requirements of the rules adopted by the Commission.” (2) 15A North Carolina Administrative Code (NCAC) 13B .0841(e) states: “Each detention and treatment facility shall be designed, constructed, and maintained in such a manner as to: (1) Prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters;” (3) 15A NCAC 13B .0841(j) states: Septage shall be transferred to and from a detention system in a safe and sanitary manner that prevents leaks or spills of septage, including septage in pipes used for transferring waste to and from vehicles. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 (4) 15A NCAC 13B .0832(a)(6) states: “All conditions for permits issued in accordance with this Section shall be followed;” SDTF-38-01, Permit Condition 2 states: “Leaks and spills are the responsibility of the permittee and shall be immediately cleaned and treated to prevent any contamination of the surrounding area. Any solids from leaks or spills shall be disposed of in a manner consistent with the N.C. Solid Waste Management Rules. The Division of Waste Management, Solid Waste Section, shall be notified at 919-707-8285 of any leaks or spill events that contact surface waters.” On October 21, 2013 a Notice of Violation was issued to Crisp Boat dock/Fontana Lake Waste Recovery Inc. In order to come into compliance, Crisp Boat Dock was required to: “Submit a response in writing within 10 days of receipt of this report providing details as to the cause of the septage release on June 27, 2013, any action taken, if any, by you and/or your firm at the time of the release to minimize impacts to the environment and/or to public health, and any actions planned by you and/or your firm to prevent any such release in the future.” On November 8, 2013, a response was received from Mr. David Crisp. An Administrative Compliance Order was issued on May 8, 2014. Resolution of the violation is pending resolution of the Compliance Order. OBSERVED VIOLATIONS: N/A ADDITIONAL COMMENTS 1. This facility consists of a 1000 gallon tank was observed housed in a covered building on a floating platform, with secondary containment. The tank appeared to be structurally sound. The building and roof appeared to be structurally sound and good condition. There was no evidence of spillage on the platform. 2. This facility was observed at Crisp Boat Dock on dry land due to Fontana Lake being at winter low levels and appeared to not be in use at this time. This is allowed 3. Signage was not present on the platform, this will need to be replaced before use. 4. Vectors were not present at the time of inspection nor were there objectionable odors observed. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
