North Carolina Solid Waste Permit SDTF-34-05, Operating Permit Condition #3 states in part: “The method for controlling odors described in the approved application for this permit must effectively control all odors created by the operation of this facility as required by 15A NCAC 13B .0841(g)”. On October 13, 2015, Carolina Resource Recovery for Liberation Capital BG Winston-Salem, LLC was in violation of A NCAC 13B .0841(g) and North Carolina Solid Waste Permit SDTF-34-05, Operating Condition #3 because sustained odors were observed by Solid Waste Section (Section) Staff at 9:10 AM and 10:15 AM near the entrance to the facility on Palmer Road. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 In order to come into compliance, Carolina Resource Recovery for Liberation Capital BG Winston-Salem, LLC was required to within 30-days after receipt of this report actions taken to remediate odors from the facility since October 13, 2015. On October 29, 2016 the Section received a correspondence from the facility via e-mail stating that an engineer was being brought in to review options for an increase in scrubber stack height. On November 25, 2015, the Section received a correspondence from the facility via e-mail that Stallings Engineering P.C. had accessed the scrubber stack for improved dispersion and assistance for approving a contractor for increasing stack height from 38.5’ to ~60’. On December 2, 2015, the Section received a correspondence from the facility via e-mail that Additional odor neutralizing fogging equipment for direct injection into the scrubber stack. On March 2, 2016, it appeared that the odor neutralizing fogging equipment for direct injection into the stack had been installed and was in operation. It was also observed that the stack height had not been increased. It was observed that the misting system located on the south side of the building was not in operation. In addition, a specific schedule for increasing the stack height has not been provided to the Solid waste Section. Please provide a justification for the discontinued use of the misting system and a schedule for instillation of additional stack height. OBSERVED VIOLATIONS: N/A ADDITIONAL COMMENTS 1. Site 1: At 11:19 AM, the temperate was measured to be 44°F and variable winds at 5 mph at Palmer Lane directly across from the Carolina Resource Recovery Facility (CRR). A pumper vehicle was observed in the unloading bay. Odors that appeared to be from CRR were observed but only for a few seconds at a time. Objectionable odors were not observed. I was at this location from 11:19 AM to 11:27 AM. 2. Site 2: At this location from 11:29 AM to 11:31 AM. Winds were from the Northwest (NW) and only a bakery smell was observed. 3. Site 3: At this location from 11:34 AM – 11:35 AM. Winds were from the NW and no odors observed. 4. Site 4: At this location from 11:35 AM – 11:39 AM. Winds were from the NW. Odors that appeared to come from CRR were observed at the beginning but was not continuous or objectionable. 5. Site 5: At this location from 11:40 AM to 11:42 AM. Wind were from the East. No odors were observed. 6. Site 6: At this location from 11:44 AM to 11:46 AM. Winds were from the NE and only a bakery smell was observed. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The permitted facility consisted of: One 10,000 gallon tank, one 10,000 raw material bin and three 25,000 gallon tanks for a total storage capacity of 95,000 gallons for the storage of untreated and treated septage. 8. The facility is permitted for the storage and treatment of grease trappings only. 9. The facility is surrounded by chain-length-fence with multiple gates to prevent unauthorized access. 10. No trespassing signs were provided on the exterior side of the chain-length-fence. 11. All waste treatment was maintained to the interior of the building. 12. The truck off-loading area was free of residues and well maintained. A second truck was observed being unloaded. 13. The misting system, located on the southern side of the building, was observed not in operation. 14. The facility logs were reviewed and appeared to be current.
