SUBJECT: Notice of Violation
Compliance Inspection Report
Al’s Septic Tank Cleaning
NCS‐00028
Cumberland County
Dear Mr. Washington:
On March 3, 2016, Connie S. Wylie, representing the State of North Carolina, Division of Waste
Management, Solid Waste Section, inspected property adjacent to 5606 Phillipi Church Road,
Raeford for compliance with North Carolina solid waste statutes and rules. The following violation
was noted:
A. N.C.G.S. 130A‐291.1(d) Septage shall be treated and disposed only at a wastewater
system that has been approved by the Department under rules adopted by the
Commission or by the Environmental Management Commission or at a site that is
permitted by the Department under this section. A permit shall be issued only if the
site satisfies all of the requirements of the rules adopted by the Commission.
On February 27, 2016 the Septage Management Firm “Al’s Septic Tank Cleaning” discharged
septage onto the ground surface on property owned by Mr. John Hill, adjacent to 5606 Phillipi
Church Road, Raeford in Hoke County. A thick dark layer (roughly 20 feet by 30 feet) of
septage was still evident on the vegetation when I visited the location on March 3, 2016. The
discharge of septage onto this property adjacent to 5606 Phillipi Church Road, which is
neither a currently permitted septage disposal site nor a wastewater treatment system
permitted to accept septage, is a violation of N.C.G.S 130A‐291.1(d).

future. Mail this certification to Connie S. Wylie, Division of Waste Management, Fayetteville

enforcement actions including penalties, injunction from operation of a solid waste management
facility or a solid waste collection service and any such further relief as may be necessary to
achieve compliance with the North Carolina Solid Waste Management Act and Rules.
