OBSERVED VIOLATIONS:
N.C.G.S. 130A-291.1(d) Septage shall be treated and disposed only at a wastewater system that has been approved by the
Department under rules adopted by the Commission or by the Environmental Management Commission or at a site that is
permitted by the Department under this section. A permit shall be issued only if the site satisfies all of the requirements of
the rules adopted by the Commission.
On February 27, 2016 the Septage Management Firm “Al’s Septic Tank Cleaning” discharged septage onto the ground
surface on property owned by Mr. John Hill, adjacent to 5606 Phillipi Church Road, Raeford in Hoke County. A thick
dark layer (roughly 20 feet by 30 feet) of septage was still evident on the vegetation when I visited the location on March
3, 2016. The discharge of septage onto this property adjacent to 5606 Phillipi Church Road, which is neither a currently
permitted septage disposal site nor a wastewater treatment system permitted to accept septage, is a violation of N.C.G. S.
130A-291.1(d).
No septage shall be discharged on land that is not a site permitted by the Department or at any location other than an
approved discharge location under Septage Management Firm Permit #NCS-00028. Completely remove all septage and
contaminated material (vegetation and soil) from the discharge area and properly dispose of this material at a landfill.
Please provide this office with the landfill receipts to document the proper disposal of the waste. I discussed this cleanup
procedure with Mr. Washington on March 3, 2016 at approximately 3:30 pm.

ADDITIONAL COMMENTS
1. At this time I received a copy of the job invoice for Al’s Septic Tank Cleaning from Mr. Sidney Palen
(landowner for the residence located at 5606 Phillipi Church Road in Raeford.
2. I also received written statements from Mr. David Avina (tenant) and Mr. Logan Wilson (a friend of Mr.
Avina’s) regarding the discharge event on February 27, 2016.
3. Pictures were taken by me during this inspection.
4. The permitted vehicle for Al’s Septic Tank Cleaning was not inspected at this time. A review of the truck logs
was not performed at this time.

enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
