Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. OBSERVED VIOLATIONS: 1.All photos were taken by Lee Hill on April 21,2016 2.The facility is owned,managed and operated by Swain County. 3.Waste is transported by Kinsland Trucking from the facility to the Waste Management Subtitle D landfill in Homer Georgia (Permit No.006-006D (SL);R&B Landfill;610 Bennett Road,Homer,GA 30547). 4.The service area for the facility is Swain County. 5.The facilities hours of operations are Monday through Friday 7:00am to 4:30pm. 6.Residential household trash is accepted at the gated,manned convenience site located adjacent to the transfer station 7:00am to 7:00pm,seven days per week. Records Review 7.The current permit and operations plan were available upon request. 8.Waste screening reports from 9/17/2015 to present were reviewed.Staff conducts approximately 2 waste screenings per week.Screenings provided good documentation of observed unacceptable waste streams and final disposition of those wastes. 9.Certified Transfers Station Operations Specialist -Jerry Dean Jenkins (expires 03/3//2019) -Timothy Guest (expires 04/16/2017) -Scott Turpin (expires 04/16/2019) -David Gunter (expires 04/16/2019) 10.The leachate collection system is connected directly to the Bryson City sanitary sewer system. 11.Scrap tire forms from 9/21/2015 to present were reviewed and appeared to be filled out correctly.Please note all scrap tire forms must have an original signature.Photocopied signatures are not allowed. 12.Tonnage records for January 2016 through March 2016 were reviewed.The facility disposed of 1776.40 tons of MSW during this period. Operations Inspection of Transfer Station (8702T) 13.The transfer station consists of covered concrete pad and metal hopper.Waste is loaded directly into the hopper bin which is located directly over the transfer trailer. 14.Only commercial traffic is allowed to use the transfer station.Residential customers are directed to the convenience site located to the south of the transfer building. Operations Inspection of Scrap Tire Collection Area 17.Scrap tires area stored in van trailers and are taken to US Tire in Concord for disposal. Operations Inspection of Electronics Area. 18.Electronics are collected,placed in Gaylord boxes and stored under cover to the south of transfer station building. 19.Electronics are sent to Synergy Recycling in Madison,NC for recycling. Operations Inspection of White Goods Area 20.White goods area stored on a concrete pad located adjacent to the Electronics collection area. 21.Refrigerants are removed on site by facility staff. Other Comments 22.The facility collects batteries and other commodities which are sent to Bailey Enterprises for recycling. 23.The facility has three glass bunkers located adjacent to the scale house.Beverage Glass is collected and sent to Strategic Recycling in Atlanta,Ga. for processing. 24.It is recommended that signage be installed at the entrance of the facility stating the permit number,hours of operation and that no hazardous or liquid waste can be received without written permission from the Division.
